Legal question RE: Texas V. Henry "Hank" Skinner?

Ok, I have been following this case lately and basically this man was arrested in 1993 and brought up on three homicide charges in the deaths of his then-live-in girlfriend and her two adult-age sons. From day one, Skinner has shouted from the roof-tops that he is innocent, but he was convicted and received The Death Penalty. Originally, his death sentence was scheduled to be carried out on Wednesday, November 9, 2011 (so in just a couple of days from this posting.) However, there was a petition circulated on Change.org, and some former attorneys, judges, and politicians from Texas wrote letters to the present-day Governor of Texas asking they (at least temporarily) forego this execution while the fight to save this potentially innocent man’s life continues. Apparently, the prosecutor from the DA’s Office assigned to this case did NOT request DNA testing on every piece of evidence (s)he could have, which included a victim’s RAPE KIT for God’s Sake! Now, I won’t pretend to be a legal expert, or a cop or anything, but I’ve seen far too many episodes of Law & Order: SVU to know that’s one of the FIRST THINGS you take to the crime lab for DNA testing so you make sure you’re busting the right "perp." Now, for the last TEN YEARS OR MORE, Skinner and his attorney have been submitting official requests to the DA’s Office asking that they go through the evidence and whatever wasn’t DNA tested before or during the trial, be DNA tested now because it very well could prove Skinner’s oft-repeated claim of innocence is true. The DA’s Office keeps denying the requests, saying something to the effect that if they wanted EVERYTHING that could have been DNA tested to be DNA tested, they should have asked that it all be DNA tested either before the case went to trial, or at the latest during the trial, but after the trial is over and the defendant is sentenced is too late. Now, again, I’m no lawyer or judge, or legal expert – far from it, actually, but this SCREAMS of Prosecutorial Misconduct to me. To me, this is the equivalent of denial of a fair trial AND denial of Due Process of Law. IMO, they need to hold off on the execution until EVERYTHING is DNA tested, and while waiting, Skinner should be in Gen Pop, or even P.C. not Death Row. If he’s wrong about the DNA vindicating him, or knowingly, flat-out lied about it and he really was the murderer of these three, then don’t delay the execution any further – proceed IMMEDIATELY as soon as the DNA results are in, IMO. However, if he’s right and the DNA shows it wasn’t him, he’s been in prison far too long for an innocent man, so he would deserve to be released right then and there as soon as the DNA cleared him. So, am I right though? Does this sound like a case of Prosecutorial Misconduct? Does a DA/Prosecutor have the right to decide which evidence does or does NOT get DNA tested or which evidence they have that will/won’t be presented during a trial? Does a DA/Prosecutor have the right to tell a potentially innocent Prison Inmate asking for evidence DNA tests, "Sorry man you should have asked for these DNA tests before the trial."? I just want to smack the crap out of this Prosecuting Attorney – it sounds a lot like he cares more about his win/loss record than whether or not he’s got the correct "bad guy" in prison.
Susan S: Thanks. I agree. Someone needs to step in and b**ch smack the Prosecuting Attorney and Judge for letting this farce go on. There is NO harm in running the DNA tests even after the trial. If it proves him innocent, he goes home, if it proves him guilty, he’s dead in 3 days as planned. Just test the damn DNA! I would think it would be worth it to make sure they don’t bump off an innocent man. These people standing in the way of justice need to be dis-barred and jailed for being so stubborn and refusing to process all of the evidence!
@dudleysharp: you raise a few valid points and a compelling argument. I wonder though, if you’re right, why they wait now until about a week before his scheduled execution to go public on Change.org (supposedly falsely) claiming all of this and saying they’ve been practically BEGGING for this other evidence to be tested when apparently they asked for it NOT to be tested before the trial started? And why is it that the information I’m reading on this is saying that when the family asked for the rest of it to be tested after the trial the prosecution said no, making the prosecutor look bad, rather than saying the defendant asked for it not to be tested, making the defendant look more and more suspicious and more and more guilty? Something’s not adding up here. I wish I knew the truth – a potentially innocent man’s life is at stake.

Apparently the same local court where he was originally tried has turned down the latest request to test DNA. If he is executed this week (as scheduled) we will never know if Texas got the right person. I believe this is indefensible- and that even death penalty supporters would want to know for sure.

The Army intelligence analyst accused of leaking thousands of classified documents to WikiLeaks was hit Wednesday with an additional 22 charges, including aiding the enemy, which is equivalent to treason in the civilian world.

That crime is a capital offense but the military is not seeking the death penalty against Pfc. Bradley Manning. If Manning is convicted of all the charges, he faces life in prison, reduction in rank to the lowest enlisted pay grade, a dishonorable discharge and loss of all pay and allowances.

The Army made the announcement of additional charges after seven months of investigation.
"The new charges more accurately reflect the broad scope of the crimes that Pvt. 1st Class Manning is accused of committing," said Capt. John Haberland, a legal spokesman for the Military District of Washington.

Other charges announced Wednesday include wrongfully causing intelligence to be published on the Internet knowing that it will be accessed by the enemy; theft of public property or records; transmitting Defense information; and fraud in connection with computers.

Be very careful when you endorse any punishment, including a date with Bubba, or else you might find that you don’t have as high a moral sense as you thought, especially should your turn with Bubba come around.

An extermly sick military veteran has been found guilty of murder and rape in more than one case, and President Bush has polished his record of being a hanging judge of Texas reputation by approving his execution. It is shame to put it perfectly. Bush is good at being a hard ass while he hides behind being a rich boy and a person never held responsible for any of his crimes. It can only be hoped that some day Bush jr will be held responsible for all that he is guilty for in the world today including the deaths of many young American kids in Iraq.

Well I am in agreement with you about Iraq but not sure about the person who has been condemn to death by guilt of rape and murder as the Governor of Texas could he not pardon the poor unfortunate man???I must make it clear I am against any form of capital punishment by anyone state or the killers they should not be killed of two wrongs do not make it right.

Based on my thoughts, what political group do I belong to? Be specific?

War- Withdraw all forces from all countries we are in. Put them at our borders and in our airports to protect us.
Drugs- legalize marijuana little by little
Abortion- Pro choice
Censorship- don’t censor anything except nudity except allow nudity on 2 or 3 networks
Business- tax big corporations, separate monopolies, but pretty much have a free market
Death penalty- If they kill on more than once, they should get they should go to jail for life, if they request the death penalty, let them have it. It mostly depends on the severity of the situation, but if they kill on more than 2 separate occassions they should probably get the death penalty
Firearms- can’t have any criminal record whatsoever, can carry concealed weapon at age 25
Healthcare- tax payers do not pay for anyone but themselves. There should be a fund that people or anyone can donate to that goes out to people in need
Marriage- anyone age 21 can get married, too many kids make mistakes, well adults make very bad mistakes as well
Gay rights- anyone age 21 can get married
Immigration- at the moment we are getting too many illegal immigrants. 60% of our troops to mexican border 5% to florida (from cuba and other countries), 5% to canada, 30% employ at airports for security. Allow immigrants for people have been granted jobs for work and progressive changes will be made
Oil- do drilling anywhere that doesnt have too many animals(sorry not very specific)
budget, economy- stop spending on almost everything, raise taxes on all those who make over 80,000 and hit the people who make 150K and over hard. Dont spend money on almost anything until we have a deficit around 10 Billion, yes billion, we are almost at 15 TRILLION
Social security- get rid of it, sorry to the people who have paid it all their lives but our children and future generations will not suffer
welfare- get rid of 95% of it, have people who want to donate do so, but get rid of almost all of it

I agree that the death penalty should be for Sex offender on Kids Recently on the state of texas It looks the congress is working in the law to be approval Are you in Favor? or Agaisnt?
The chances of getting the wrong person for a crime is now 0% in my opinion and mostly when they have LONG criminal records I mean I see on tv they arrest people with 4 to 11 pages in crime history I mean that people is just Not right
Why should animals be allowed to live like Ian Huntley or any other rapers or serial killers that could be your neightbor or your friend Would you loose any sleep if he was dead?

death penalty takes too LONG and too much MONEY. instead of losing troops we should drop off the criminals and a box of weapons and if they win the war they win their freedom… in ANOTHER COUNTRY!

While in the Illinois State Senate, Obama supported homosexual marriage, racial preferences, the banning of all firearms, flag-burning, socialized medicine and the absolute right to abortion, including partial-birth abortions. He voted against requiring medical care for aborted fetuses who survive an abortion. He is anti-war, voted against the reauthorization of the USA Patriot Act, against privatizing Social Security and opposes the death penalty, three strikes laws and school vouchers. He has no military service record. He strongly supports the decriminalization of marijuana.

A group of clergy in Kansas City this week criticized a local evangelist for attending a church rally this weekend in Uganda.
The country is considering legislation that would allow the death penalty for homosexuals.
The clergy group, called the Kansas City Coalition of Welcoming Congregations, urged Lou Engle, a co-founder of TheCall ministry based in Kansas City, not to spread a homophobic message.
“Engle is known for his message of God’s wrath and has a track record of referring to gay people as having demons,” according to a statement by the coalition.

Who else wants the names of Minors who are convicted of crimes to be exposed?

After that bias crime that happened in New York’s Lower East Side where two 12 year olds and a 15 year old were captured their names must be released and they must be sentenced as Adults. No more cuddling or "sealing" their records. The Death Penalty must be applied to Minors as well. No more of this Liberal Justice. This nation needs a return to the Reagan Laws.

I am familiar with this case- the acts were despicable and thankfully the victims will be okay. I am also very angry about this. At the same time I remember the Central Park jogger case- also horrible- and the ad taken out by Donald Trump suggesting that the people arrested get the death penalty. I don’t remember the exact age of the defendants but they were all juveniles. Several years later, after the defendants were convicted and had served over 5 years, DNA pointed to the person who really committed the horrendous acts. Charges against the original defendants were dropped.

Following particularly heinous crimes there are always calls for the death penalty. That is one of the reasons we have a trial and tread very carefully.

CNSNews.com) – Attorney General Eric Holder has directed prosecutors in a federal conspiracy and murder trial not to seek the death penalty for three El Salvadoran men who are in the United States illegally.

The three are accused of robbing and shooting Claros Luna on July 29, 2009 in Alexandria, Va., just a few miles from the Justice Department, as Luna transported a prostitute from Maryland to Virginia.

The suspects, Eris Arguera, Alcides Umana and Adolfo Amaya Portillo, admitted to being members of the MS-13 gang, court documents show. They were indicted on Nov. 24 on federal racketeering and murder charges.

A Justice Department spokeswoman told CNSNews.com that the department would not comment on Holder’s decision not to seek the death penalty in the case. She directed CNSNews to an online “resource manual” stating that the attorney general’s decision-making process and final decision on whether to seek the death penalty is confidential.

But the manual also states that no information on the process can be disclosed outside the Justice Department “without prior approval of the Attorney General.”

According to court documents, in a letter dated Feb. 3, 2010, Attorney General Holder “authorized and directed” U.S. Attorney for the Eastern District of Virginia Neal McBride “not to seek the death penalty against Alcides Umana, Adolfo Portillo and Eris Ramon Arguera.”

McBride filed a corresponding document – Government’s Notice of Intent Not to Seek the Death Penalty – on Feb. 16.

Peter Carr, a spokesman for the U.S. Attorney’s Office in Virginia, told CNSNews.com that Holder, as U.S. attorney general, makes death penalty decisions in federal cases. “The decision to pursue or not pursue the death penalty in a death-eligible case resides with the Attorney General, not the U.S. Attorney,” Carr said.

Court documents indicate that the death penalty at one time was being considered in the Salvadorans’ case.

Early on, a court-appointed attorney for one of the defendants was dismissed because he did not have the proper certification for a trying a death penalty case. Also, attorneys for one of the defendants entered a motion on Feb. 18 seeking to use a questionnaire that would eliminate jurors who might discriminate against Latinos. That questionnaire alluded to the death penalty.

Another motion by defense attorneys sought to keep gang affiliation from being part of the trial because of the possibility that it might bring a death sentence.

(Other questions for potential jurors included, “Do you believe people born in Central or South America deserve a lesser standard of justice or greater scrutiny because they are probably not really supposed to be here in the first place?” and “Do you believe people born in Central or South America deserve harsher punishment if they commit a crime because they are already accustomed to being uncomfortable and deprived?”)

An FBI press release issued the day after the three men were indicted by a grand jury stated that the case was under investigation by the FBI, Alexandria Police Department, Fairfax County and Arlington County Police Departments and the U.S. Immigration and Customs Enforcement (ICE).

ICE spokeswoman Cori Bassett said the immigration agency filed paperwork to begin deportation proceedings in case the men are not convicted or if they are released on parole. If that happens, the Salvadorans would be remanded to ICE custody.

“We do not have any record of ICE encounters with the individuals prior to 2009,” Bassett added.
