How to obtain medical records of deceased relative from Florida?

June 29th, 2010 1 comment

I’ve lost 3 people in my family to a disease. I’ve been told to get their medical records for screening purposes regarding my own health and the health of my children. I’ve been able to get the records of all but one. This is my brother whom died in Florida in 2007. We are told the only people that can get the records are the three listed on the death certificate. I had one of them do this. Now, we’re being told differently – that only the person who filled out the death certificate form (his wife) can access the records. Currently she is already remarried and wants no part in helping. What is the law? Who exactly can get the records and how do we go about this without getting help from the wife? We are out of state. We also were told my doctor could not request these records without a court order showing "just cause" – family history of a disease is not a reason… so we are told. Please help.

I would suggest you hire an attorney who specializes in health and/or family law. Good luck.

petty theft misdemeanor first time offense.?

March 26th, 2010 4 comments

i stole about 250$ out of a register at work. i got caught and i signed a paper stating that i did steal the money and that i’m sorry. and i am sorry. its my first and last time. but i don’t know what to do. my court date is on the 19th of january in the state of florida. i am really sorry about having done this. and its seems to me i just screwed up my future. does anyone know whats going to happen to me? please help if you can. i know i need to get a lawyer but am i going to go to jail for this? and will this stay on my permanent record? the police officer said i can get it expunged from my record. please explain this to me. i’m in dark here and i’m scared half to death.

Each state has it’s own laws about what kind of offenses and dispositions can be later expunged from your record. The Florida Department of Law Enforcement is the government agency that processes expungment requests, http://www.fdle.state.fl.us/content/getdoc/c83dd888-ef7a-448e-9a96-ba69fc4181f7/Seal-and-Expunge-Home.aspx The website cites the Florida Statute that determines who is eligible to have a charge expunged. It is not easy reading and it is best to have an experienced lawyer explain the criteria.

In some states, the only time a charge can be expunged is when the defendant was not actually convicted. If you are placed on probation, conditional discharge (a nonreporting form of probation) than a conviction is entered and you are ineligible for expungment. But it is a different story if you are placed on court supervision. If you complete court supervision successfully, a conviction is not entered and you can file a petition for expungment. I am not familiar with Florida’s system but it may be similar. It is very important that you understand before you accept a plea agreement whether you will be eligible for expungment at a later date. Talk to an attorney and good luck!

What is the current average term served for rape?

March 8th, 2010 5 comments

Without making any excuses for him, my father was convicted of rape when I was a baby, 21 years ago. He was into drugs and bad stuff, but I’d like to at least mention that he’s a wonderful person now (and a much better father than the man who raised me, and then took off on his wife and 6 kids, rarely to be heard from again), so if you’re here to inform me that he should have been put to death or something, please don’t. I hear it enough.

Anyway, he’s been up for parole several times, but he’s been denied. I was wondering if anyone knew what the average time served was in the case of rape? My father has been moved to a minimum security prison, has a spotless behavior record, is captain of several inmate sports teams and manages the on-site manufacturing company the prison runs. I’ve long learned not to get my hopes up, but these "flops" are getting a bit ridiculous. I know a boy who got less time than my father has served for second-degree murder, after which he helped the actual killer cut up and burn the body (Michigan "Thrill Kill" case).

So, yea, I tried searching and none of the useful pages would load. Thanks ahead of time!

I don’t think there really is any average amount served. I’d say it’s a good sign that your father has been moved to a minimum security prison. Hopefully, they’ll parole him at his next hearing and then you can help him acclimate to the real world. Things have changed drastically while he’s been gone and will need your support.

Good luck.

What happened to the bodies of 1918 Influenza victims?

January 29th, 2010 4 comments

During some research for family genealogy, I came across a little confusion about the flu epidemic of 1918. My great grandfather was drafted to WWI and reported to Fort Riley, Kansas in sept of 1918, by Oct 15 he was dead. Now no one knows where his body is and there was no death certificate issued. His death just kind of become a common knowledge thing but with no actual proof. Where bodies just disposed of with no record of who had died, like in a big burn ditch? Where could I look to find some hard copy proof? I’ve been to Kansas dept of vitals with no luck either. Thanks in advance!

That is an interesting question. I gave a link that has lots of information regarding the epidemic. It was also postulated that the folks didn’t die of the flu, but the cytokine storm that was invoked by the virus, because generally healthy young adults were among the most that ended up dieing. The very young and very old were spared, mostly because their immune systems were slow to react as opposed to those healthy younger adults. Good luck with your search.

Can I order a Death Certificate of someone who wasn’t a blood relation or married to?

The person passed away in Orange County, California. Can I go online and do this? Or must this be done through the Hall of Records in Orange County. Is it possible to go through the Hall of Records in Los Angeles County? The Death Certificate is for financial reasons. I shared a deed to a timeshare (and a bank account) with this person and if I ever sell it, I believe I need to provide this proof.

yes rose you can do it — you will have to pay a processing fee and give a reason!!!! good luck!!!

free death records?

December 21st, 2009 4 comments

My grandmother’s name was Patricia J. Donahue (Stein). She died in August of 1990 in Florida and that is all I know. Can anyone help me find any records online? Links would be helpful.

A search for Patricia Donahue turned up several matches on www.rootsweb.com (URL attached). I’ve also attached a couple of other links for free searches. If she never received benefits from Social Security the chances are she will not be listed in the rootsweb database. I didn’t see an exact match for someone with her first and last name who died in 1990, but it can be quite a search. If you write to the state of Florida (see the last URL I posted) you can request a death certificate. Good luck – you’ll find her if you’re persistent.

Death Record in California?

December 14th, 2009 1 comment

My birth mother married an American (not my birth father) and moved to California. Sadly she died in 1990, long before I managed to find her. I have found her death record via Ancestry.com and now I would like to get a copy of her death certificate. I searched the website for California Vital Records and I am unsure as to whether I am entitled to apply for a copy of hercertificate. I THINK that I can apply for an ‘uncertified’ copy but could anyone verify that please? I was born in, and still reside in the UK and my mother was Engish

If I were you, I would contact the American Embassy I’m sure they can tell you what you need to know,

Good luck and good hunting
