Right ,where are they? I had to get a passport several years ago, I had one 20 years before but it expired so I needed a new one. I showed my birth certificate that was from a hospital, it was the only one I had and it was not acceptable. Since 9-11 they needed an official one from the state or city of birth not a hospital. That hospital one was good for over 50 years and now I needed another one. So I had to go to the hall of records in NYC and have a new official birth certificate printed up. So why as just an ordinary citizen did I not have a problem getting a new official birth certificate, and then a passport. Why can’t we see Obama’s official one, what is the big deal, why can’t he just show it. What is he hiding, and how did he get a passport, didn’t he have to show the birth certificate when he got it? I want to see it, I have a right to see it and so do you and all Americans!

I understand the need for answers. However some of these things aren’t going to actually serve any real purpose. Some of it is already obtainable on line.

1.) Although, I understand the confusion, as Obama was supposedly born in Queens hospital before he was born in Kapi’olani Hospital. This is why people want to see a registration of birth (not a live birth certificate).

2) His mother’s death certificate should be public information. She was born 11-29-42 died,7-11-95 age 52, in Honolulu. Her SS# was 535-40-8522

3) The funeral home records wouldn’t be public record.

4) Again Probate records are public information

4) You can find basic information on his 7 step brothers and sisters, on his father’s side, born to four different women. (Their addresses are not, nor should they be public information). There is also another step-sister from his mother and you can find her on line.
.
5) Father’s name: Barack Hussein Obama. Good luck on a death certificate – he died in a DUI in Kenya 20+ years ago!

6) He refuses to OK the release of these – probably because, according to his friends he was a B- student, not a genius.

7) Immigration records – good luck with that – he didn’t immigrate. He was here on a Student Visa in the 60’s.

8.) He refuses to release this or any college or university records!

The reality, which is hardly paranoia, Bob, is as follows:

Are all those Kenyans lying about our President? Shame on them. His grandmother says she was there at the Coast hospital in Mombosa when he was born. The Ambassador for Kenya, Peter Ogego, admitted that Obamadrama was born in Kenya and he plans to have a monument erected in his honor. Reverend Kweli Shuhubia has signed an affidavit stating that "it is common knowledge throughout the Christian and Muslim communities in Kenya that Barack Hussein Obama, Jr., the United States Presidential candidate, was born in Mombosa Kenya." The affidavit is basically regarding participating in a telephone interview that was done between a U.S. Minister and Sarah Obama, the grandmother. Many Kenyan Obama family members were present during this interview – and it was all recorded (http://www.thecommentary.net/obamas-grandmother-says-he-was-born-in-kenya/)

Hey, zaphod73! There is a difference between a "certificate of live birth"(what the Obamamaniacs are touting as a birth certificate) and a "registration of birth" (http://www.orlytaitzesq.com/obama-certified-copy-of-registration-of-birth-in-kenya.htm). The first, anyone can get even if they weren’t born there – it’s been done several times in Hawaii, since this issue came up. The second has all of the details of the birth and is submitted very shortly after the birth. Don’t act so superior unless you have some idea about what you are talking about. Obama is a liar and a loser – Deal with that! And if you believe you have a right to privacy, other than in your own home – you are truly uneducated.

To the morons out there, who believe that Osamabama has some particular right to privacy you aren’t too bright. All presidents release this type of personal information. He is the first that hasn’t. Bush and Kerry released their information, as did Clinton and others. Usually there is no need to ask, it is just done.

Therefore, when The One absolutely refuses to release pertinent information, it makes one wonder what is he hiding? If he is so intelligent, such a genius, why won’t he release his college/university transcripts? You think he’d be so proud of all those A’s and would be setting a good example for those little children. Why would he spend millions to fight court action requesting his registration of birth? It only costs about five bucks – don’t you wonder why?

BTW, interrob, to answer your moronic question "Why doesn’t John McCain release his "allegedly dead" mom’s death certificate?" She’s not allegedly dead! She is alive and well – and he proved it by bringing her on the campaign trail. Not to mention, she was a guest on Leno a few months ago. DUH! Perhaps you should educate yourself a bit more before you comment on things about which you know nothing

The entire issue of Obama proving where he was born has nothing to do with Democrats or Republicans – it has to do with the Constitution of the United States, Article II Section I, paragraph 4: "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States." So, he needs to prove he is eligible. It’s the law!

To RU Quazee: lots of that stuff is available online – and some is very questionable, as well. Copy of school registration in Indonesia, selective service registration – very questionable, can be found here: http://www.theobamafile.com

Dude I don’t even like the new president. I didn’t vote for him. He is a fake and he is already spending more $$$ in office making the U.S. more in debt. Next 4 years are going to be hell with him in office. Thanks America for voting for him that wanted Change!?!?! You got what you asked for America! I think it wasn’t about electing him in office b/c of politics, I think people elected him in office to make history for the first black president. Next thing you know it, America will have Indian, Native American, Chinese, Japanese, Hispanic, Hindu, Islamic, German and more presidents like that. & when that happens America will be a wasteland.

Making A Spanish Will

January 31st, 2010 6 comments

None of us likes to think about making a will, it reminds us that one day the inevitable will happen and we will no longer be here. How ever, consider for a moment all the time and effort you put into providing financial security for yourself and your family, working hard, putting money into pensions and saving to buy that dream home abroad. Then when we have achieved our ambitions, we fail to take the next step in protecting our assets after we pass on.

It is imperative that we decide what should happen to our money and possessions after our death and ensuring that those people and causes that matter most to us are provided for. Making a valid will is the only way of guaranteeing that you take control now of what happens to your assets when you die.

There are thousands of British citizens who own properties in Spain. Many of them are elderly and yet they have made no provision as to what should happen to those assets on their death. Who will take over their assets in Spain, and how much inheritance tax will have to be paid. For these reasons, it is important that you arrange your affairs to make life easier for your heirs and the change of ownership of your assets.

You should be aware that this is only a general guide and cannot replace professional advice

What will happen if there is no will?

If a foreigner dies in Spain without a will, his estate may be automatically disposed of under Spanish law.

If you are British and own a property in Spain the laws of England and Wales state that, your property should be subject to the inheritance laws of Spain.

However, in Spain the law states that property owned by a foreigner should be subject to the inheritance laws of their original country. Confusing!

For a normal British family with property in Spain, where the asset will pass to the spouse and children, the situation is not complicated, but it does require answers to some questions

a. Do I have to make a will?

The answer is no, it is not obligatory to make a will. However, if a foreigner dies in Spain without a will, his assets will be distributed in accordance with Spanish law.

b. Will a will made abroad be accepted in Spain

Generally, a will, which is valid under the law of your home country, will be taken to be valid in Spain
Currently lawyers are advising British domiciled individuals with property in Spain to write a will under Spanish law stating that they wish to have their Spanish assets disposed of in accordance with their national law, i.e., in accordance with the inheritance rules of England and Wales. They also advise such individuals to update their British will to take into account their Spanish property.

If you have lived in Spain for a long time and you want to dispose of your assets according to the law of your home country, then it may be necessary for you to create a legal domicile in your home country for the purpose of making a will

c. Is it better to make a will in Spain?

If you own a property in Spain and you want to save your heirs a lot of time and expense then the answer has to be YES. A Spanish will for the distribution of your assets as per the inheritance laws of your home country will be accepted by a Spanish notary.

The time limit for making an inheritance tax declaration in Spain is six months from the death. If you are waiting for the probate from the home country to be issued, and then have to make the translation and get the “apostille” (can be used whenever a copy of an official document from another country is needed) before taking it to Spain, you may miss this time limit and be liable for fines.

With a will in Spain, you can to an extent regulate the distribution of the assets. For example, you can make sure that your spouse will have the undivided user’s right for life, or that only one of the children takes over the property in Spain, the others having been compensated by assets in the home country.

You can also make an inheritance tax saving by making the right kind of will.

Different Types of Will

There are a number of different ways to make a will in Spain, here are the main ones:

Open Will (“Testamento abierto”)
This is the most common form of will. Here you tell your lawyer or the notary the contents of your will. The notary then signs the official form together with the issuer. The notary will give you a copy of the will and send a copy to the Registrar in Madrid. The original remains at the notary’s office. If you do not understand Spanish, you will need a translation into a language that you understand fluently. It is only mandatory to have two witnesses to the signing of a will if the notary or the issuer requests it

When the issuer dies and before adjudication can be made, a search must be made in the registry in Madrid to find if a will has been deposited there. Even if no will has been registered, written confirmation from the registry in Madrid is obligatory.

Closed Will (“Testamento cerrado”)
The contents remain secret; however, it must be drawn up by a Spanish lawyer to ensure that it complies with the Spanish law. The issuer then places it in a closed envelope. He may then seal the envelope in front of the notary and at least two witnesses. The notary records it as for an open will. The issuer may keep the envelope himself, give it to a person in confidence for safekeeping or deposit it with the notary.

Hand-written will (“Testamento olografo”)
Written and signed by the testator in such a way that there can be no doubting its authenticity, must also be dated. It must be drafted to ensure that your wishes are clear

The will is a private document, which becomes a public document after the death of the issuer. It can be kept safe or given in a sealed envelope to a person in confidence. It needs no witnesses, nor a confirmation from the notary. It can be voluntarily registered with registry of wills. On the death of the testator, it must be authenticated before a judge, which will delay its execution.

Whilst this form ensures complete confidentiality, it may easily be forgotten or lost. It should only be used in exceptional circumstances.

It is advisable to have your will drawn up by a Spanish lawyer in Spain. Keep a copy of your will in a safe place and another copy with your lawyer. The inheritance tax declaration and the payment of inheritance tax duties must be made within six months of your death if you die in Spain and sixteen months if you die elsewhere. Inheritance tax must be paid in advance of the release of the Spanish assets.

We are not qualified to give legal or financial advice we would say that if you think you might be affected then you should seek qualified professional legal advice.

The thing is, either you are confused about what these documents are, or they are absolutely none of your business. In this country people have the right to privacy, which means nobody has the right to demand non-existent documents from you, either.

My best guess is that neither you nor I has ready access to a single document of our own on your list. Does that mean we were both born in Kenya? ?°)

If I’m not mistaken, such records can only be subpoenaed if it can be demonstrated in court that the person asking for them has the legal need to do so as part of a valid case.

Just wanting to see them doesn’t meet that criteria. As the Supreme Court has pointed out, btw.
