I have a legal question!?

August 6th, 2011 1 comment

My ex-husband died in 2006 in Florida. We share two children together. When he died I was contacted by his father telling me that he couldn’t handle his son’s last affairs without me signing and allowing his father to do so. I am not sure why I was the one that would have been responsible but I signed the necessary form. Years later I can’t find any public records on his estate. He still has assets in his name. There was a vehicle that was restored. His father and I had a conversation after his death. We came to the conclusion that the vehicle would be auctioned and the proceeds would be distributed among his children. To the best of my knowledge the process hasn’t been completed and I believe that the vehicle is still in possession of a car club that he belonged to. I am now wondering if there is any legal standing for my children or if there is a statute of limitations.

Unfortunately your genuine claim is barred by statute of limitations.

The process did not require your signature unless you were still listed as a beneficiary, however the next of kin would have been the children and not the father so he had to be assigned as executor in order to file for probate, apparently the property is sitting in limbo and nothing has been done, you need an attorney to stand in for the children and get their share of the estate.}{

how can I find in public records the blood type of my deceased ther? I only have birth and death certificate?

He died 20 years ago and there are no other documents left in our possession.

In the US, unless you catch a flukey, darn lucky break, you aren’t going to be able to acquire that information.

Given this person died 20 years ago, blood typing of newborns just wasn’t done. So there would be no recording on the Birth Certificate (as you probably have already found).

Unless there was some reason to do an extensive autopsy (very rare) it is unlikely any death "record" would have this information either.

So this information would only be in medical records. In the US though, with the passage of HIPAA laws, you won’t be able to get those records unless maybe you are a direct descendant. Maybe.

A little know fact is that HIPAA extends to deceased persons as well as living persons. You can’t release medical information on a deceased individual (one argument, an insurance company could find your deceased parent died of ovarian cancer and thus bump up your rates because you now have a higher chance of getting this condition).

A consequence of HIPAA is that doctors and hospitals are purging old records. Technically, they can’t retain medical records without a medical reason – and clearly there is little medical reason to retain the medical records of a patient that died 20 years earlier.

So unless you catch a fluky, very unusual break somewhere, you aren’t going to be able to get this information (in the US anyway).

So now that Mexico has legalized drugs?

will that mean addicts can take a trip to Mexico for a trip and not get arrested? Border towns may have to thank Mexico for the increase in real estate market.

And for the record, I side with Mexico with their approach. It’s the only sensible alternative to thwarting crime and death from enforcement which has failed miserably.

So, what is your opinion of Mexico legalizing the possession of heroin, cocaine and marijuana?

Hooray for the government of Mexico’s respect for individual freedom. Consenting adults should decide for themselves (with easy access to factual information to base the decision on, of course) whether they wish to take the risks involed in using mind altering substances like marijuana, tobacco, cocaine, caffeine, alcohol, etc … not have Nanny Government make their decisions for them. I hope that Act 2 is Mexico giving the USA the same message Canada gave us when asked to cooperate with our efforts to enforce Alcohol Prohibition: "Enforce your own stupid law."
