HELP! Caught shoplifting in California?

Before I write, I know I am going to be faced with a lot of prejudice and anger. First and foremost, know that I deeply regret this stupid decision, and it was my first time (I was careless because I knew it was wrong and still did it, but at the same time I just was so fed up for living in near poverty for so long).

I stole $80 of merchandise at JC Penney. They were on sale, so when I was caught, they marked it as the actual retail price which was $165. I slid the items into my purse and thought I was home free despite I was terrified. My boyfriend was with me and thought that I would make it out okay. We were caught by the door by the LP Agent who said, "You must come with me" and dragged us quite painfully to the detainment room.

There they questioned us if we did it, took our things, our identification, phone numbers, everything except our social security. Eventually we admitted our wrongs and returned everything, but because of our ages (24 and 23) they decided to prosecute under California Penal Code 490. We were not read our Miranda Rights. We signed some papers. One of them was the list of items that were stolen and we were going to pay for them, second was the ban of the premises for 6 months, and we are uncertain what the third paper was (if we did, we cannot remember as we were frozen in fear). We were arrested on the spot and taken to the police station despite we were cooperative and agreed to to the ban, apologized, returned the items in tact and unharmed, and agreed to their civil demand. The Police also did not read us our Miranda rights, and we were not interviewed. We had our photos and fingerprints taken and once we were cited, we were released. We were given a court date. We are unable to sleep and are frightened to death. We have never done anything like this before, and while many people said that admitting to the wrong doing was bad, we thought we were doing the right thing by admitting the guilt. We are literally riddled with grief with the fact this will damage our future careers because of a small, but frustrated, mistake.

Anymore facts include: The theft was in California, we were not interviewed or recorded by the Police, we were not kept in jail for more than an hour for them to book us, and insofar we’ve cooperated and showed great remorse for our actions. But we don’t know what to do now. We are told to consult a lawyer, but we have hardly any money to afford one (in fact, the theft was on the basis we hardly have money). We are going to seek a Public Defender, but we are unsure of how this will all cost.

If no priors, probably no jail time, a fine, and a short stint with probation (possibly informal).

As for your rights not being read: If you research miranda questions, either here or somewhere else, you’ll find that your rights only need to be read to you if you are in custody AND the police wish to interview you. That’s pretty much it in a nutshell. Everything else is television B.S.

As for all the paperwork at the store: That’s fairly common. They can pursue you civilly as well as prosecute you criminally. You can be charged with trespassing if you return to the store (and usually any other J.C Penny).

Family Tree question!?

I’m stuck on my great-great grandfather on my family tree. i have his birth year, his death year, his social security number, and I know he was in world war one. Ohio (his birthplace) didn’t start keeping birth records until 1908 though. is there anyway I can find out the name of his father? He was born in Ohio, but lived & died in Wisconsin. I just want to be able to find his father’s name. I don’t really care about anything else.

His SSN application, $27, should have his father’s name and his mother’s maiden name. His death certificate might have them. His marriage record might have them. The article about his wedding in the local paper’s society pages, on microfilm in the library, may have them.

You could post his name, DOB and the places he was born in and lived in (town, COUNTY, state) here and someone might find him on the census. That isn’t as good as the SSN app, but it is free. It isn’t as good because if he lived with an uncle and called him "Dad" because his parents died when he was young, he might be on the census with relation "son" instead of "nephew".

When someone dies in unknown Hospice Care Center..where do they take the Body? How can I find out ?

I’ll try to keep this as consise as humanely possible:

Great Aunt Dies. (mid 80s, Alzheimers. Within last 3 days).

Her "next of kin" is terminally ill & in Care Facility. Can not be reached. Has no info anyway. Not coherant.

Great Aunt had been removed from her original Hospice Care to ANOTHER Hospice Care Facility that is UNKNOWN. Both unknown.

Aunt passes away.

Someone (unknown) phoned adult relative who had a brain aneurysm (6 yrs ago) and is = to a young child, to give details. All she remembers is they said Auntiie Gwennie died. She did not write down what was said. Caller i.d. says RESTRICTED.

The only other "next of kin" is a relative who’s recovering from brain surgery. (I only WISH I was trolling, kidding, or lying). She doesn’t know anything and is in NYC.

No, there is no foul play suspected.

I don’t know how this process works. There is no one (able enough) to ASK. I have no idea about any last directives, or her wishes. She wasn’t capable of complex thought for years. I don’t know if they pronounce someone dead at Hospice, or they send them to Hospital, or the Morgue, or what. I don’t know where (her body) she is. I’ve been searching, on-line, to get a list of possible Hospice Care Centers, Morgues, Mortuaries..even Arizona newspaper obits.. but I can’t get any info. I understand medical and death records are private, but if the "next of kin" are not capable, then I have to find her and make arrangements. There’s no one else.

I do not have her Social Security Number. No one does.

WHERE ARE THEY TAKEN? WHAT HAPPENS TO THE BODY?
Hospital? Morgue? Coronor? Do any of the above RECORD this anywhere? She lived in Arizona. I live in California.

Getting panicky.

I could go to/phone to take care of her body?

Here in Illinois a body is stored at the Morgue until the funeral home comes out to get the person if the death occurs in the hospital. At least here. In order for you to be in a hospice program that has to be already arranged. You might try consulting the first hospice location to see if they can direct you to the other. Another try is I am sure a death has to be reported to the coroner either way.

Walter Imbiorski mystery?

HUGE mystery. Walter and wife Pauline show up in 1920 Chicago census, with children Steven, Lawrence, Adeline. I find he had another daughter in 1915, who seemingly died. Per that census, he was born about 1888 in Poland. I CANNOT find him in any other census. Can’t find him in Illinois death index, findagrave, or google, except for recent obit of his daughter. He is not the Walter who died in 1944. He is not the Walter who was born in 1925 (1944 Walter is father to him).
EVERY Imbiorski in the SSDI is accounted for, and linked to my grandfather Andrew who immigrated before 1888, and his 4 sons. I have census for each of the 4..no Walter who FITS. There is an excellent documented file at rootsweb..he is not in that. I spent hours yesterday at familysearch, found tons of items, but nothing further on THIS Walter.
I don’t have ancestry.com, so if he has an immigration record, or full census showing when he came, I don’t have that. This ISN’T a common name where I could think there isn’t a relationship.. every other Imbiorski is documented and connected, as well as linked to Chicago. An Emborsky family in NY is likely to be a brother to Andrew, but that does not help here. Have been in touch with his granddaughter, who only knows her mom’s brothers name Steven. Want to be able to validate my connection to her.
Where did he come from, and what happened to him? What am I missing here, gang?
the key solution is posted here, but am leaving this open for anyone else to input… my thinking is that he and Pauline/Pearl died after 1950 (end of Illinois death index) but prior to social security death index which begins about 1960ish. I have a lead on what happened to Steven but not Lawrence…

Wendy, I checked Monavo and found a Walter Imbiorski who was born about 1896 and married Marie in 1920 in Winnebago County IL Archives Marriage Recordshttp://files.usgwarchives.org/il/winnebago/vitals/marriages/marri.txt

Ancestry also has a WW2 draft card for a Walter Imbiorski born 12 Dec 1881 in Poland, This would have been from 1942.

Ricardo Villalobos was born in the Philippines in 1881 & died in Seattle in 1970. Anyone know more about him?

I’m researching his genealogy for a friend of mine. I have had trouble finding his obituary in newspaper microfilm because I don’t know the exact date that he died. Does anyone know this or where I can go to find it out. He does not show up in the Social Security Death Index, or rootsweb, or ancestry.com. Google searches typically bring up stuff about an unrelated Mexican singer of the same name.

Is there a (preferably free) place where I can access records from the censuses that the United States took in the Philippines while they were still an American colony? I’ve tried the National Archives in Washington State. They have everything else including the Panama Canal Zone, but for some reason they don’t have the Philippines even though it was a U.S. territory back then and there were at least three censuses taken by the U.S. in the early 1900s.

Ancestry.com doesn’t have the Philippine census either, nor can I find it anywhere else. Anyone know where I can find it?

How do i find someones death record?

Can someone PLEASE tell me how to find someones death record or can someone search it for me ? Someone recently died but the thing is im not sure if that person is really dead because they live in another state (Its my aunts boyfriend) The person who ”died” lies alot so it is very hard to believe 🙁 someone please answer asap thank you!!!!!!

It is way too early for this individual to be showing up in any death index. It takes about a month for the Social Security Death Index (SSDI) to be updated, for example, and, even then, some individuals never show up in an index for one reason or another. We could look for an obituary, but California is a BIG state with a LOT of major newspapers… an impossible search without knowing the general place of death. Also, in some cases, the deceased does not get an obituary or death notice.

You will just have to wait until the next SSDI update. In the meantime, you and your aunt might try learning more about Osvaldo’s alleged place of death. Does he have family members that you can ask?

i have custody of my younger brother and i recieve a check from social security for him through my dad, i just received a letter in the mail that his check will be going up becasue a person who was also receives benifits has been removed, no longer recieving any benifits, the only 2 receiving benifits are my brother and dad, dould this mean he died??? he is a alcholic and a homless man so how could i find out? are death records public in ohio??? i really need to find out
im still getting a check its just bigger now and he is only 16, my dad tho is 68 im so confused

My husband and I have been married for 10 Wonderful Years! I would not give him up for anything. He grew up in Upper Class Catholic Orphanages – is Bi-Racial – Was Never Adopted. He has Never seen a member of his family or knows them. He was given a ‘letter’ from the NYC Catholic Diosese of New York to get his ID and Social Security #. He has a major degree from the University of Arkansas and had his own Construction Buisiness that was Highly Sucessfull in Texas. We know his mothers name – which is our last name and his father – who is dead June 1994! The Catholic Disosese Refuses to let him know anything! He has no Crimanal Record of any kind. He is the my best friend and the finest person I have ever met! We have gone to Attorney’s, National Archives (Where I found his father’s record of death). He just wants to know where he came from. When he got on Social Security Disability Nothing was required.

Public Death or Police Records?

I’m trying to learn more about the death of a family member that occured in 1985. I have reason to believe I haven’t been told the truth regarding the cause of death and I’m hoping I can learn more by reviewing police records of the incident. I know the full name and social security number of the individual. Where do I go to get police records related to this persons death and perhaps new articles written at the time?
