What are the charges for death threats in New York?

My friend’s girlfriend cheated on him. He found out the other man’s number, called him and threatened to kill him. (no chance he will actually do it) The other guy recorded the phone call and reported it to the police. My friend was told to turn himself in to the police today. However he got a lawyer and now has to report to the police on Sunday. My question is how much trouble can he get into for making a threatening phone call? He has a clean record, no police history whatsoever. This all took place in New York. Since there was more than one phone call exchanged between them we are giving the call logs to the lawyer.

There are very stiff laws on terroristic threatening in the state of New York. Your friend was stupid to leave something on a machine like that. He will get something, but it will probably be plead down to probation and anger management training or something. This type of behavior usually escalates, so he really should get help, and get it with the intent to learn something.

If I remember correctly, about 6 months. But tell your friend to not say anything, get a lawyer. He should be able to get it knocked down to probation if he does not have any past offenses on his record.

Well it is against the law. But I don’t think it’s a great big deal. First time ever in trouble. The Judge will let it be pleaded out. to a slap on the ass.

About $100, depending on who you get to make the threat.
