Here are ten useful tips of advice from a personal injury lawyer to follow if you have been in an accident. You can also learn more about how to handle a personal injury in Chino, or any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com  and learning how we can assist you.

Obviously, if you have had an accident, and you are reading all of this advice, it’s probably been at least a few days since the accident. However, if it’s only been a few hours or if you ever have another accident, here’s what you should do the next time from the start.

First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, it’s just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.

Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.

Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. But if you are dazed or confused, let them know you need medical treatment and answer only what you feel sure about. Remember, your statements can and will be used against you if you admit fault, and it will be too late and too fishy to later say you didn’t know what you were saying at the scene. Police know that your best recollection is immediately after an accident.

Fourth, get the other driver’s information including their names, addresses, driver’s license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.

Fifth, if you have a camera on your cell phone or in the car and you aren’t too injured, take some photos of the vehicles and the scene. If you can’t do it right away, do it after you are released from the hospital.

Sixth, if you are hurt, obtain medical treatment. Don’t decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, don’t get treatment you don’t need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.

Seventh, call a good personal injury lawyer as soon as you have had your initial treatment, so the attorney can gather other important evidence and prevent the insurance company from taking advantage of you and obtaining such things as recorded statements that you feel fine, when many of your symptoms have yet to manifest themselves. A good personal injury lawyer can save you from making a great deal of mistakes and can shoulder much of the hassle of knowing what to do about car repairs, car rentals, medical treatment, witness statements and the like. If you think you will save money by not having an attorney, think again. A good personal injury lawyer can almost always obtain much higher settlements, obtain reductions of medical bills and insurance liens and prevent you from making costly mistakes. Also, most personal injury attorneys advance costs of obtaining police reports, medical records and the like and are paid and reimbursed for these costs only out of any settlement.

Eight, you will need to report the accident to your insurance company, but since they will want to take a recorded statement from you, just like any other driver’s insurance company, it’s good advice to retain an attorney first. And if the other driver did not have insurance, remember that it is your own insurance company that will be your adversary. You will also need to report the accident to the Department of Motor Vehicles and your lawyer can give you the form for this.

Ninth, do not agree to settle your claim privately with the person at fault for the accident. This almost never works out to your advantage. Don’t agree not to call the police. Police reports that determine the fault for an accident are golden. Your agreement to not involve the police only affords an opportunity for the other driver to change his story and blame you when the police will no longer investigate the accident.

Tenth, don’t pay a traffic ticket without a fight if you weren’t at fault or agree to accept a small payment for your vehicle repairs without knowing that the amount will in fact cover the cost of all the repairs.

If you’ve had a personal injury in Chino, Orange County, Newport Beach, Anaheim, Irvine, Huntington Beach, Corona del Mar, Laguna Beach, Santa Ana, Orange, Fullerton, Costa Mesa, Westminster, Buena Park, Mission Viejo, Garden Grove, Laguna Niguel, San Clemente, Chino Hills, or anywhere in Southern California, we have the knowledge and resources to be your Chino Personal Injury Lawyer and your Norco Personal Injury Attorney. Be sure to hire a California law firm with auto, motorcycle, truck, bicycle, pedestrian, car, bus, train, boat and airplane accident experience, wrongful death experience and insurance law expertise who can ensure you are properly represented and get the compensation you deserve.

If you have a personal injury legal matter, a dog bite or if you’ve lost a loved one in a wrongful death accident, call the Law Offices of R. Sebastian Gibson, or visit our website at http://www.SebastianGibsonLaw.com  and learn how we can assist you.

Giant wave (Mike Parsons at Jaws Beach / Hawaii)

July 27th, 2011 25 comments

Mike Parsons (born March 3, 1965) is a surfer sponsored by the Billabong company who famously successfully surfed a 66-foot (22 meters) wave at Cortez Bank, CA in 2001, for which he was awarded $66,000, the highest prize ever awarded in the history of professional surfing. This money was awarded by the Billabong XXL competition which has run since 2001 paying tribute to the biggest waves ridden each year. This feat at Cortez Bank was popularised by the film Billabong Odyssey. Parsons is famous for a video clip of him riding a wave about 65 tall at Jaws, shot from a helicopter, that many believed was the biggest wave ever surfed. Parsons recently broke his record on January 5, 2008, at Cortez Bank, when he was photographed surfing a wave that the Billabong XXL judged to be 70+ feet, which should put him in the Guinness Book of World Records, officially, for biggest wave ever surfed. Unofficially the biggest wave ever surfed remains Ken Bradshaw’s wave at Log Cabins, Oahu on January 28, 1998, at over 80 feet.

While I’m Waiting – America, the land of the free?

Wrongful conviction isn’t an epidemic that is new to our country. But through DNA evidence we’re learning how prevalent it is. From the University of Miami Innocent Project: Florida has one of the highest rates for wrongful convictions in the nation. Since 1973, over 24 Florida death row prisoners have been exonerated through the use of DNA and other scientific practices not available at the time they were convicted. But lack of DNA is not the only reason for wrongful convictions, false confidence in eye witness identification, improper police procedures and ineffective counsel can all add to a wrongful conviction.

DEATH ANGEL on CAPITAL CHAOS 2008

July 27th, 2011 11 comments

DEATH ANGEL on CAPITAL CHAOS 2008 @ The Boardwalk~Orangevale, CA 5/28/2008 also on the bill were GOD FORBID, SOILENT GREEN & LIGHT THIS CITY Death Angel, formed in 1982, is a Filipino-American thrash metal band from Concord, California. Death Angel broke up in 1991, but reformed at the Thrash of the Titans benefit concert for Chuck Billy in 2001. http://www.myspace.com/deathangel
Death Angel was formed in San Francisco, California, in 1982 by Rob Cavestany (lead guitar), Dennis Pepa (Bass guitar, vox) and Gus Pepa (rhythm guitar), and Andy Galeon (drums), who are all cousins. After considering a number of different names for the band, including “Dark Fury,” Cavestany and D. Pepa settled on the name “Death Angel” after coming across a book by that title in a book store. In 1983, the band released its first demo, Heavy Metal Insanity, with Matt Wallace serving as producer. According to Mark Osegueda, the group was then “more like a metal band, more like Iron Maiden, Tygers Of Pan Tang and stuff like that,” as the so-called Bay Area thrash movement was only just beginning to rise to prominence at the time, and make its influence felt. Osegueda, a second cousin of the other four members who had been working as their roadie, became the group’s vocalist in 1984 and performed his first show with the band on a bill with Megadeth in April of that year (at one of the four Megadeth gigs to feature Kerry King on guitar).

Death Angel continued to play club gigs in and around the San Francisco Bay area for nearly 2 years, writing songs and refining their stage show. In 1986, the band recorded the Kill As One demo with Metallica’s Kirk Hammett (whom they had met at a record store signing in 1983) as producer. Due to the underground tape trading wave of the early 1980s, the demo was distributed extensively and brought the band to the attention of a still-wider audience; Osegueda later recalled that prior to the release of the band’s first album, “we were playing in L.A. and New York, and the crowd was singing our songs, because there was this underground tape trading….That’s what keeps it alive, and I think that’s absolutely wonderful.”

The success of Kill As One led to a record deal with Enigma Records, who released Death Angel’s debut album The Ultra-Violence in 1987. The band recorded The Ultra-Violence while its members were all still under 20 years old, and the album sold 40,000 copies in just one four-month period. A video was filmed for “Voracious Souls,” a song about a band of cannibals, but it never aired on MTV due to the nature of the lyrics. The group released the follow-up album Frolic Through The Park in 1988, which spawned the single “Bored”, the video for which did receive regular airplay on MTV’s Headbanger’s Ball. Frolic featured more diverse material than the straightforward thrash of the first album; the album included a cover of Kiss’s “Cold Gin,” and the relatively light, playful “Bored” was written under the seemingly unlikely influence of U2, and the guitar playing of The Edge in particular. The band toured worldwide for the first time and found notable success in Japan, selling out 2 full Japanese tours.

Geffen Records bought out the band’s contract with Enigma Records in 1989 and released the third Death Angel album, Act III, in 1990. Produced by Max Norman (who had previously worked with Ozzy Osbourne and Megadeth), the album showcased the band’s newfound use of full-band backing vocals, while fusing elements of funk, thrash, and heavy metal with the use of acoustic guitars to give the album a varied feel, while staying true to the group’s heavy roots. The album featured the singles “Seemingly Endless Time” and “A Room with a View” (a ballad sung mostly by guitarist Rob Cavestany), and both songs also received airplay on Headbanger’s Ball, but a mainstream breakthrough still proved elusive. (The band released the “A Room with a View” video and single under the name “D.A.,” and Cavestany explained to a reporter at the time that he now found the band’s original name “restricting. The name Death Angel seems to imply hardcore thrash gloom-and-doom death metal, and we’re not like that at all. If I were presented with 10 records, and one of them was by a band called Death Angel, and I’d never heard of them, I’d stick that one on the bottom!”)

For people who hated the Percy Jackson flim (Everyone nearly then)?

July 26th, 2011 5 comments

It doesn’t matter if you have read the (awesome)books or not as I have a list here! Well the flim had left everything out that was any good, do you think if they had everything in from the books it would have been better? Here is the list

There are some huge differences and minor differences. Such as:

– The novel starts with Percy at boarding school, not with Zeus and Poseidon talking about the thief.

– Annabeth and Percy are 12 in the novel (the reason for the change is stated in an earlier question).

– Medusa is killed by looking into a crystal ball (once or twice Percy’s sword), not by looking on the back of an iPod.

– Hades does not want the bolt, though he is suspected throughout the novel, but it is revealed he just wants his missing helm back, which Luke stole along with the lightning bolt, and which Ares confiscated and hid in order to take advantage of a war between Zeus, Hades, and Poseidon.

– There is a party on Olympus after the bolt is returned.

– The Hydra is not in this novel, neither is Nashville. Instead, the three go to St. Louis, and while in the Gateway Arch, the Chimera and Echidna attack Percy alone, leading to an explosion. However, the Hydra appeared at the second novel of the book series, The Sea of Monsters and instead of fire, the creature spits acid.

– The pearls are not a major part in the book. Percy falls from the St. Louis tower in the novel and falls into the Mississippi River, where he meets a water nymph who tells him of the pearls. He goes to Santa Monica to retrieve them.

– They go to Aunty Em’s in the novel due to an attracting aroma, not to find a pearl.

– Ares plays a major role against the trio in the novel, often trying to make their quest fail. In a scene cut from the film, much like the novel, Ares picks them up from the diner and takes them away, gives them supplies and clues on how to get where they want to go. He is tricking them, however, and Percy has to fight Ares in L.A.

– The book has the entrance to the Underworld in the fictional DOA Records building, not the Hollywood sign.

– In the book, they don’t drive to Las Vegas, they hide in an 18-wheeler, where they are with abused zoo animals. It’s there Percy learns he can talk to horses (Poseidon is the God of Horses).

– Percy is at camp a week before playing Capture the Flag, not a day.

– Camp Half Blood in the novel has separate cabins for each god, excluding the minor gods and Hades where it was largely elaborated and has different themes base on the what the god is known for. Percy has a very large Poseidon cabin all to himself for the first book.

– It’s not mentioned in the film, but Annabeth is never very trustworthy with Percy at the beginning, as Athena and Poseidon have a rivalry from centuries ago.

– Annabeth is blonde in the book.

– Luke, Annabeth, and Thalia, a daughter of Zeus (mentioned in a deleted scene), were friends from an early age, and lived on the streets and fought of monsters. They eventually arrive at Camp Half Blood, where they are being chased by multiple monsters. Thalia’s protector is Grover as well, and she decides to stay behind and fight so the rest can get to safety. She is injured to the point of likely death, and Zeus takes pity on her and transforms her into a Pine Tree, who now guards the the camp and provides a "shield" from monsters. Annabeth also harbors feelings for Luke for the entire series.

– Percy and Annabeth meet in the infirmary (this was originally in the film, though cut)

– The flying shoes Luke gives Percy are cursed in the book, and Percy never uses them. Zeus hates Percy, as he is the son of Poseidon, and so Percy can’t use them, because if he flies, Zeus can strike him down for going into his domain. He gives the shoes to Grover, and while in the underworld, the shoes try to drag him down to Tartarus.

– There are "Iris Messages" half bloods use, where through water and mist, they offer coins to Iris, the Goddess of rainbows, and with this they can communicate with anyone they need to, and they use this several times.

– Persephone is not in the novel, as it is summer, and in mythology, she would be with Demeter, her mother.

– Annabeth is on Percy’s team in capture the flag.

– Camp characters, such as Clarisse, daughter of Ares, Beckendorf, son of Hephaestus, Selina Beauregard, daughter of Aphrodite, Connor and Travis Stoll, twin sons of Hermes, etc. are excluded in the film.
Zeus never says that the gods are forbidden to see their children in the novel because the gods become too "human," but only the big three can’t have children (Zeus, Poseidon, and Hades), because their children are too powerful. After WW II, this was proclaimed. Roosevelt was a child of Poseidon, Churchill a child of Zeus, Hitler and Stalin children of Hades. It is an ancient guideline that the gods are not allowed to be involved directly in the battles of their children. Also, they cannot play favorites with any of their children (though on his fifteenth birthday, Poseidon does tell Percy that he is his favorite child), which is why the gods and goddesses do not see their children often. There is also the fact that these children were brought up by their mortal parents, and some (like Mrs. Jackson) probably did not want to involved their children in the life expected for a hero.

– Luke claims in the movie he never met his father. In the book series Hermes is well aware of Luke and ev

Poseidon has many more kids, some that Percy even meets and comes across in the series.

– The gods aren’t British in the novel. It can be assumed their accents change wherever they go to whatever they want.

– In the novel they don’t drive around the country. They find other ways around, using buses, walking, getting rides, or in one case, hopping in the back of an animal-smuggling truck (there Percy learns he can talk to horses).

– Capture the Flag isn’t nearly as brutal in the book. Chiron states "No killing or maiming allowed!" (to the displeasure of the Ares cabin), and while you could get injured, cut and bleed, Chiron, let alone the other campers, would not have tolerated nearly killing Percy for fun. It was Clarisse, not Annabeth, who inured him in the novel anyway.

– Over the series, Percy has to train to become a great sword fighter. It doesn’t come naturally.

– The entire layout of Camp Half-Blood is different. It is located in a field on Long Island, not in the middle of

You’re right. The movie really stinks. Although, i gotta admit – Logan Lerman was really hot. Among all other things they took out from the book, they even removed the Oracle! For crying out loud, people, where’s the Great Prophecy? What’s the point of the whole movie if that’s not included? I’m so sorry for Rick.

How can I obtain the details of the death and cremation of someone in who died in California?

July 26th, 2011 6 comments

This person died in Oakland, Ca, in 2005. I have date of birth, death and full name and want to find the details of his death (by natural causes) and particularly the location of his ashes. I want to use public records and not a paid service.

You can write to the Alameda County Clerk-Recorder and buy an informational copy of his death certificate:
http://www.acgov.org/auditor/clerk/death3b.htm

"Public" doesn’t mean "free"; it just means "Available". By contrast, most adoption records and the details of some civil suits are "sealed". That means you cannot buy copies no matter what.

It is $14, something they hide on a different page,
http://www.acgov.org/auditor/clerk/vitalrecords.htm

for their own convenience. Government web designers don’t have to think of the public’s convenience.

Even then the death certificate may not reveal where his ashes are; they may have given them to the family, and the family may have scattered them somewhere illegally.

It is illegal to walk through a wilderness area, for instance, a place the deceased spent many a happy hour backpacking, and scatter his ashes here and there, paying particular attention to patches of lupine. My son has promised to do that for me, and fiddle dee dee to the USFS.

Are these the same people?

July 20th, 2011 5 comments

I know that my great grandmother’s name was Kathryn Lescher and that lived in Ohio as a child. I found her in the 1910 census living with her mother whose name is listed as Mary King. I then proceeded to find a death record for a Mary Lescher who was also born in Germany, buried in Ohio and died in Michigan, which is where she was living towards the end of her life. On this death record, her father is listed as having the last name Stein. I then found a marriage record in 1902 for a Mary Stein and a Joseph Lescher in the same area of Ohio. Finally, I found a death record for a Joseph Lescher in 1907 and a marriage record for a Mrs. Mary Lescher and a John King in 1908. Given all of these records, does this all seem to fit together well enough to conclude that these are the same people and in fact my ancestors?
Sorry. John King was also in the home in 1910. I was able to find Mary in the 1900 census but she was living with her sister who she must have come to America with while her parents stayed back in Germany.
Also, her burial was in the same place as where she lived for a large portion of her life growing up.
And the 1910 census says she’s married twice to further back up the two different marriages. The only weird thing is that with the dates she would have married at about 17 years old to a man about 13-14 years older. On the other hand, John King is 13 years older than her as well, so I guess that makes it seem more believable.

Almost all of it is real clear that Mary was married 1st to Joseph, married 2nd as widow to John King, and thus her name is correct in the 1910 census.
My question might be what happened to John King? he wasn’t in the home in 1910? did she divorce him and resume using the prior Lescher name?
Whether or not the death record is your Mary is open to question, even with the last name of Stein. You would need to match up the dates to determine if it is close enough. WHERE is the Ohio burial? is it in the same location as she was raised?
I would still work to find Mary in the 1900 census, and define who the parents were. If they are buried in the same locality as the Mary whose death record you have.. it would be more evidence.
