Can illegal immigrants get away with crimes?

EVERYBODY NEEDS TO READ THIS: Near where I live, an ILLEGAL ALIEN gave birth to a baby in a portable toilet and left it to drown in urine and feces…..

The child was discovered Sunday morning by Dave Marshall, who went to clean the toilet for C.B.’s Portable Restrooms, near Hermiston. Marshall pushed a black plastic wand into the hole beneath the toilet seat to vacuum waste and felt something odd, said C.B. Kreutz, the company’s 62-year-old owner.
"He looked a little bit closer and he saw what he thought was like a doll," Kreutz said. "And of course, it felt kinda heavy. … He looked closer and saw that it had an umbilical cord."
Marshall and a co-worker summoned police.
Araceli Velasquez-Espain was arrested Monday on charges of aggravated murder, which potentially carries the death penalty; murder; first-degree manslaughter; second-degree corpse abuse; and criminal mistreatment. She is being held in the Umatilla County Jail on a federal immigration hold.
"She’s been a seasonal employee for us for some time," said Nina Pyle, the human resources director for Atkinson Staffing Inc., which provides farm labor in Oregon and Washington. In recent weeks, Velasquez-Espain had weeded peas or carrots at a farm near Boardman, she said.
No one at Atkinson was aware Velasquez-Espain was pregnant, and the company would have required a doctor’s note saying she was capable of working in that condition, Pyle said.
Government records show no legal resident of the United States with Velasquez-Espain’s name and date of birth. But she presented a Social Security card when applying for work at Atkinson three years ago, Pyle said.

REGION: Woman acquitted after baby found in toilet

Heppner A Mexican woman has been acquitted of a murder charge after her baby was found dead in a portable toilet near a field where she was working in Eastern Oregon.

The East Oregonian reported that doctors testified 22-year-old Araceli Velasquez-Espain did not realize she was pregnant or had given birth.

The doctors testified about a number of factors that contributed to her unawareness about the pregnancy, including her weight and unusually quick delivery.

An autopsy revealed the baby was alive when he was born last year.

Circuit Judge Jeffrey Wallace also acquitted Velasquez-Espain of all other charges in the case.

How does this make you feel about our Justice system towards illegals?

"Araceli Velasquez-Espain did not realize she was pregnant or had given birth." How could a woman not realize she had given birth? That is a lie! A woman is in intense pain during labor, and immediately afterward! The baby would have made a cry or something, and the mother would have had heavy bleeding. Yeah, they literally get away with MURDER!

Is this a good decision by this judge?

Will this open the doors to other families who have had family members who were victims of illegal aliens?

Judge Lets Victims’ Kin Take City of S.F. to Court

SAN FRANCISCO — The family of a father and two sons who were slain in San Francisco last year can go to state court with a claim that the city is to blame for failing to turn their alleged killer over to immigration authorities when he was arrested earlier as a juvenile, a federal judge has ruled.

City Attorney Dennis Herrera had asked U.S. District Judge Susan Illston to rule on the claim herself after dismissing the rest of the suit last month by Tony Bologna’s widow and daughter. But Illston said Friday that the remainder of the family’s case – that the city’s negligence caused the killings – belongs in Superior Court because it is based on state law and challenges San Francisco’s policies.

Bologna, 48, and his sons Michael, 20, and Matthew, 16, were shot to death near their home in the Excelsior district in June 2008. Edwin Ramos, 22, is charged with murdering them.

Ramos, a native of El Salvador whom prosecutors describe as a member of the MS-13 gang, was arrested twice as a juvenile, for an assault in October 2003 and an attempted purse-snatching in April 2004. Juvenile courts sent him to a shelter after the first incident and to the city-run Log Cabin Ranch in the Peninsula hills after the second.

Case records don’t show whether police or juvenile courts knew that Ramos had entered the United States illegally. But under juvenile authorities’ interpretation of the city’s sanctuary policy at the time, they would not have passed that information along to federal immigration officials. Federal authorities learned of Ramos’ status later but did not take him into custody for deportation proceedings.

The family’s lawsuit says the city was responsible for the shootings because its policy allowed Ramos to go free.

Last month, Illston rejected the family’s claim that the city’s actions violated the shooting victims’ constitutional right to due process of law. She said the city might be held to account if it knew Ramos posed a specific threat to the Bolognas, but not for releasing someone who allegedly endangered a large segment of the public.

Herrera’s office urged Illston to address the negligence claim as well, arguing that it was governed by the same legal standard: a requirement that the plaintiffs show city officials knew the Bolognas were in danger and had a duty to protect them.

But Matthew Davis, the family’s lawyer, said Monday that California law makes it easier to hold government officials accountable for allegedly harboring illegal immigrants or preventing police from reporting them to federal authorities.

Yes. When the criminal illegal alien was released the chances were very high he would re-commit.
The city is responsible. They chose to disregard his illegal status, even though he was a criminal. They released him into the public. If they had deported him and he re-entered then I would say the city was not responsible.
If I have a vicious dog and I release it on the street and it bites someone I am responsible and can be sued.

Trial begins for illegal alien accused of killing Colorado toddler and two others

Illegal alien Francis Hernandez is on trial this week in Arapahoe County District Court for an automobile crash that resulted in the deaths of three people, including a 3-year-old boy.
Francis Hernandez, faces a total of 19 charges, including vehicular homicide, leaving the scene of an accident involving death, and child abuse resulting in death.
On September 10, 2008, the parents of 3-year-old Marten Kudlis buried their son at Fairmount Cemetery, a few days earlier, he was killed while waiting for his ice cream in an Aurora Baskin and Robbins.
An SUV speeding through the intersection of Havana and Mississippi, with Guatemalan national Francis Hernandez at the wheel, slammed into a pickup truck, which was then pushed into the ice cream shop´s window. The toddler was sitting at a table in front of that window, and was sent flying as the truck came crashing through it.
Police say that Hernandez was traveling at a speed of at least 70 mph.
After the crash, police say Hernandez jumped from his Chevy Suburban and fled the scene. He was later apprehended without incident.
Marten was taken to the hospital, but died a short time later due to massive internal injuries.
The two women in the pickup truck struck by Hernandez were Patricia Guntharp, 49, and Debra Serecky, 51. They were both pronounced dead at the scene.
KMGH of Denver covered the child´s funeral and reported that the first song heard during the service was Eric Clapton´s "Tears in Heaven."
In a heart wrenching display of grief and anger, Marten´s mother Marat Kudlis shouted: “That bastard!,” referring to the illegal alien believed responsible for killing her son. Between the tears, Marten´s father cried out: “I really loved him.”
The rabbi conducting the service told the heartbroken family and friends: “This burden feels like more than we can bear because it is so sudden. It´s a parent´s worst nightmare. It does not seem fair and it is not fair to lose someone so young.”
A teddy bear was placed in the tiny open casket which held Marten´s body.
Following the funeral, many of the mourners returned to the crash site, which became a makeshift memorial, filled with flowers, stuffed animals, and cards with expressions of sympathy and support for the Kudlis family.
One of those mourners, Duane Stokes, told a KMGH reporter: “I helped pull Marten out of the building. I was right there with him. He squeezed my hand. I held his hand until he passed on. My fiance and I were just saying a prayer to Marten and just getting one last glimpse of everything around here. Just to say goodbye to him.”
Marten´s death hit the community hard and his funeral was attended by many people who had never even met him, but were saddened and angered by his senseless death.
Hernandez who has 12 aliases and two dates of birth, has been arrested an astonishing 19 times since 2003. The Colorado Bureau of Investigation has also, confirmed that Hernandez has been arrested by nine different police departments. Despite his lengthy arrest record and illegal status in this country, Hernandez has never been deported, nor have deportation proceedings ever been started against him.
The police report shows that after Hernandez ran from the scene, he phoned his girlfriend, Brenda Aleman, asking her to come pick him up at a local Hooter´s restaurant. The report reads: “(He) stated after the accident he was scared and fled the scene, he was afraid he would be taken to jail because he had no insurance, no driver’s license and that would prevent him from seeing his kids.”
Hernandez and Aleman have two small children.
It should be noted that the Congressional Research Service has classified both Aurora and nearby Denver, CO, as a “sanctuary cities.” The term refers to a policy taken by cities which refuse to inquire into an arrestee´s immigration status, or a refusal to inform federal authorities when a suspect in custody is believed to be or known to be an illegal alien.
Shortly after little Marten‘s death, retired Congressman (R-CO) and former presidential candidate Tom Tancredo said that Denver Mayor John Hickenlooper, as well as Colorado Gov. Bill Ritter "have blood on their hands."
While both Hickenlooper and Ritter have long been criticized for their opposition to enforcement of our immigration laws, Gov. Ritter tried to deflect any attention from his office onto the federal government and called Tancredo´s comments “out of bounds.”
In response, Tancredo issued the following statement: “While it might be politically expedient to blame Washington for what happened this week or to characterize my criticism of him as ´out of bounds,´ the fact remains that Gov. How many more of our children will have to die before our border and our laws are taken seriously by those sworn to defend both?

I don’t’ condone violence, but I have to agree with Weird Al. Whatever it takes to wake these people up to reality. If it ever happens to me or mine, watch out. The fallout will be loud and long.

People who enter another country should respect that country and it’s laws. If you really want to stay and thrive, you need to live a good life and contribute. People who come and violate laws and harm people do not deserve any chance what so ever. There is no way in H*LL we should be forced to be victims of crime committed by illegal aliens.

A 26-year-old driver who registered four times the legal limit for driving while intoxicated on a breath test pleaded guilty in Howard County Circuit Court this afternoon to causing a crash that killed a Marine corporal and his date at a Columbia intersection on Thanksgiving night last year.

Eduardo Raul Morales-Soriano of Laurel pleaded guilty to two counts of negligent manslaughter in the deaths of Cpl. Brian Mathews, 21, of Columbia, and Jennifer Bower, 24, of Montgomery Village.

He will be sentenced Nov. 29. Prosecutors said they will ask Judge Lenore Gelfman to impose a term of eight years in prison, the maximum under state sentencing guidelines
After he completes his sentence, Morales-Soriano is expected to be deported, said State’s Attorney Timothy J. McCrone. Authorities believe he entered the country illegally from Mexico, McCrone said.

Morales-Soriano, who worked as a landscaper in Montgomery County, slammed his Nissan Sentra into the rear of a Toyota Corolla driven by Bower that had stopped at a red light on Route 175 at Route 108.

He had a blood alcohol concentration of 0.32, according to a Breathalyzer test administered by police. Under state law, a motorist is considered to be driving while intoxicated with a level of 0.08 or higher.

Mathews, a 2003 Howard High School graduate based at Camp Pendleton, Calif., had come home for the holidays and was on his second date with Bower when the crash occurred. He had finished serving eight months of duty in Iraq in 2005 and was due to leave the military this year.

Prior to last year’s fatal crash, Morales-Soriano was charged in Prince George’s County with negligent driving, speeding and driving the wrong way on a one-way street after being stopped in Riverdale in July 2006. He was found not guilty, according to court records.

In February 2006, he was given four citations after an auto accident in a Columbia parking lot in which he refused to take a Breathalyzer test. No one was injured and prosecutors later dropped the charges, citing weak evidence.

He used a driver’s license issued in North Carolina in 2004 to legally obtain a Maryland driver’s license in 2005.
