My widowed mother threatened to ditch me for Foster Care/City House care in Texas. Is it legally possible?

April 16th, 2011 2 comments

Normally this wouldn’t be a big deal if it was once, but this is the 5th time this year and she says she wants to kick me out because I’m a medical burden and rebellious.

She threatens to have a lawyer sign me over and have me live at city house with life insurance for my dad’s recent death. She also threatened foster care and abandonment in an Ikea store. I want to know if this is legal for her to do any of the above 3.

We have a CPS record for various things but nothing serious. She assaulted me 2 weeks ago but the police blew me off and told me to grow up.

Me: 15/Male/High School Student in texas. Suffering from various medical issues that have to be taken care of ASAP.
Mom: Widowed for a little over a year.

I would REALLY appreciate it if you informed me about the legality of these threats. It sounds possible but then again, don’t all parents want to ditch their kids?

Thanks!
We got into the arguments about my life-threatening case of pectus excavatum.

Yes some days all parents want to ditch their kids and go to the beach. Then the kids come screaming in the house and need lunch and the parents forget about it and tend to their little darlings. I am sorry she is verbalizing these things to you, she sounds like she is at the end of her rope and concerned that she cannot take care of you. Legal, I don’t know. Appropriate to say to your kids, NO. Hope you can find a counselor at your next school and talk to someone about how all this is affecting you.

Wills and Death Benefits is it Public Record.?

My Granddad past away in 1973, he worked for the Rail Road. How could I find out where his death benefit went to whom it may of been given. Also if there was a will at time of death. Would this all be public Record.

Wills are public records. Death benefits and beneficiaries of life insurance or annuities, are not.

My job failed to follow through with a change of beneficiary.?

My husband passed away on 1-31-06 from sickle Cell Disease. We would have been married 3 years a week before his death. We both work for the Chicago Transit Authority in Illinois. We have Life Insurance through our company. One year and prior to his death, we went down to the company headquarters (Merchdise Mart) to do a change of beneficiary making each other our beneficiary. We submited the forms and that was it. After his death I found CTA had never made his changes. They made him my beneficiary but did not make me his beneficiary. I was told the only record of beneficiary they had in his folder was his ex-wife, from 1998. My in-laws encourage me to continue to fight this and not give up. The young lady that received the document we submited no longer works for the company. The insurace money is still there. I’ve lost my home and I’m in a real financial bind. Please! Can someone help?
I was given a copy of the change form making him by beneficiary. I was told his folder was completely empty.

see a lawyer. you need professional help.

What is your age?

As a minor dependent of your father you may be entitled to Social Security benefits as a dependent survivor.

As a minor dependent of a disabled veteran you may be entitled to survivor benefits from the Department of Veterans Affairs.

If you father was a disabled veteran he must have been in the military. If he was retired from the military you may be entitled to dependent survivor benefits from the military.

You may file claims with each of these agencies to determine whether or not you are eligible. Or, if you are too young, you may have a "guardian ad litem" file the claims on your behalf.
You do not need the permission of your step mother to file these claims on your own behalf. These are benefits that you, yourself, may be legally entitled to.

Good luck.
