scared to death about criminal record?

i have a lengthy criminal record that i’m ashamed of. im only 24 and spent a year in rehab. two nights ago i busted because someone had a pipe in my car and i had to take the rap for it. whatever the case the only thing i had going for me was that i completed a year of christian rehab and now everything is ruined. Im from tn and am going to be going to a school for finance in florida so i have two more years before i start looking for a professional job. I’m scared to death that my record which includes one felony will prevent me from ever having a finance job. im getting a ba degree will I be able to find anything. I have been crying all day and have lost almost all hope.
let me correct this it was my weed pipe.i just im not a drug addict i was only smoking alittle bit. i just didnt want it to come off sound horrible

Dont worry dude, tons of people get exeptions and jobs of all sorts. First off, your way better off then lots of people. People would kill to be you.

Question about Pardons in Pennsylvania?

I want to begin the process of obtaining a pardon for crimes I was convicted of from an accident back in 2002. Basically I went to 2 different pardon attorneys and recieved very different information. I assume this is because until I pay a retainer they are not going to spend anytime looking at my case. I want some other oppinions.

I was charged with Homicide by vehicle and reckless endangerment for an accident in which I was unable to stop for a red traffic signal and collided with another vehicle in which the other motorist was killed. Back then i was young and nieve in thinking that my attorney would actually help me. Instead he forced me to plead guilty to these crimes. At face value, everyone comes to conclusions thinking I must have done something wrong otherwise I wouldn’t have been charged this way. I say BS, there was no extenuating circumstance that I commited with gross negligence. Now I believe, at most and by talking to other officers, and reading about law that I should have been charged with Carless Driving with Accidental Death. I did nothing to warrant criminal action in that accident.

So talking with one attorney who barely had any facts and contacted the pardon board, said they would not grant a pardon for something like this. She said people need to know about it. She also said the only way I would have a chance is if I could prove I was wronfully charged. The other attorney with little information said I should wait until 15 years pass and then file for a pardon based on the fact that I have trouble obtaining jobs. He said accusing them of excessive charges would not go in my favor and that it is water under the bridge.

These people are contradicting eachother and I am confused. I feel like I have to say I was somehow wrongfully charged, however I am afraid I will get denied like the second attorney said.

Please, someoene who knows something about law give me some advice. I am desperate to have this criminal record removed. I am not a criminal and don’t believe I should be looked at as a criminal.

The second attorney is pretty much right on. The fact that you plead guilty and the facts are not in dispute will make things considerably more difficult.

Your allegation that you were "forced" to plead guilty by your attorney does not hold water. Don’t go there.

The reason people conclude that you "must" have done something wrong to get the charges you did is because that’s how it works. The state "must" prove that you’ve done what the law describes for that charge in order to be convicted. The judge would not allow you to plead guilty to a charge either if it didn’t appear that you actually did what the charges say you did. You can’t plead guilty to bank robbery if there’s no evidence that a bank was actually robbed, and you can’t plead guilty to vehicular homicide if you were simply in a bad accident.

Based on my thoughts, what political group do I belong to? Be specific?

War- Withdraw all forces from all countries we are in. Put them at our borders and in our airports to protect us.
Drugs- legalize marijuana little by little
Abortion- Pro choice
Censorship- don’t censor anything except nudity except allow nudity on 2 or 3 networks
Business- tax big corporations, separate monopolies, but pretty much have a free market
Death penalty- If they kill on more than once, they should get they should go to jail for life, if they request the death penalty, let them have it. It mostly depends on the severity of the situation, but if they kill on more than 2 separate occassions they should probably get the death penalty
Firearms- can’t have any criminal record whatsoever, can carry concealed weapon at age 25
Healthcare- tax payers do not pay for anyone but themselves. There should be a fund that people or anyone can donate to that goes out to people in need
Marriage- anyone age 21 can get married, too many kids make mistakes, well adults make very bad mistakes as well
Gay rights- anyone age 21 can get married
Immigration- at the moment we are getting too many illegal immigrants. 60% of our troops to mexican border 5% to florida (from cuba and other countries), 5% to canada, 30% employ at airports for security. Allow immigrants for people have been granted jobs for work and progressive changes will be made
Oil- do drilling anywhere that doesnt have too many animals(sorry not very specific)
budget, economy- stop spending on almost everything, raise taxes on all those who make over 80,000 and hit the people who make 150K and over hard. Dont spend money on almost anything until we have a deficit around 10 Billion, yes billion, we are almost at 15 TRILLION
Social security- get rid of it, sorry to the people who have paid it all their lives but our children and future generations will not suffer
welfare- get rid of 95% of it, have people who want to donate do so, but get rid of almost all of it

What do you think Deported Criminal Illegal Immigrant Murders Baby?

In the latest example of the government’s failure to protect the nation from criminal illegal aliens, a man responsible for the atrocious murder of a California infant has turned out to be a drug-addicted illegal immigrant deported after a felony conviction.

Somehow the violent criminal, Juan Sanchez, sneaked back into the U.S. and lived under the radar in the southern California community of Rancho Cucamonga about 50 miles from Los Angeles. He recently beat his girlfriend’s 8-month-old son to death after the infant’s nose was “mistakenly” wiped with the methamphetamine-laced cotton swab Sanchez used to clean his pipe.

Fearful that he would be sent to prison, Sanchez forbade his girlfriend from seeking medical care when the baby became sick from the drug exposure. For three days the barbaric convict tried to get the infant “off the high” by shaking him, slapping him and tying him to a bed. When the baby was finally hospitalized, he had a skull fracture, bleeding in the brain, detached retinas and a broken arm.

The mother and Sanchez have been charged with the infant’s horrific murder. A sad component to this depressing story is that Sanchez should not have even been in the U.S. because in 2001 he was convicted of robbery and deported. He crossed the border illegally and authorities had no idea of his whereabouts until he committed this heinous crime.

Just last month a previously deported Mexican man with a criminal record killed an entire family when he crashed his car into theirs on a Houston freeway. The illegal alien (Juan Felix Salinas) had been deported two years ago and was free on bond in a criminal case yet was allowed to remain in the country. He had a blood alcohol level three times the Texas legal limit when he murdered the family.

And they only come to get a better life…oh yeah, right.
We need to fully secure the border.
Deport the illegal aliens, but first add them to a DNA-data base as well as the fingerprint data-base. Then, if any try to come back in legally, deny them.
So much for their values. These incidents are not isolated but occur on a daily basis.
Less than 3.5 % of Americans are incarcerated for felonies.
Illegal aliens are incarcerated at much higher percentages.
It is a total travesty than any illegal alien could return after deportation to commit further crimes and one of the worst ways the government is failing to serve the people.

Why do Americans feel the need to give underage drinkers a criminal record?

live in Canada, and among the aspect of the United States that I find very silly, there’s the 21-year-old drinking age and the ridiculous penalties for underage drinking. This is greatly undermining the opinion I have of the US.

In Canada, the drinking age is 19 in seven provinces and 18 in three. If someone is caught underage drinking, they are either handed a small fine or arrested and detained until the effect of alcohol is over, that’s all. Underage drinkers don’t lose their driver’s license and don’t get a criminal record that would haunt them for the rest of their life. Additionally, enforcement is much less strict, and police often don’t really care about underage drinking on private property.

I think that American policy of giving a criminal record to underage drinkers is unfair and exaggerated, as a criminal record permanently jeopardizes employment and emigration, and will get a person barred from entering Canada for 5 years. You want to visit Toronto, but four years ago you were caught drinking at the age of 20? Impossible, you’ll get arrested and deported at the border. The punishment doesn’t fit the "crime" at all.

In the state of New Mexico, it’s a FELONY to give alcohol to someone under 21, but only a MISDEMEANOR to drive drunk, even on the third offense. Any reasons for that?

Underage drinking and drunk driving are two entirely different things. I take drunk driving very seriously and I even think aggravated drunk driving (over .12) should be a felony.

Canada has a lower rate of car crashes and deaths and far less problems with alcohol use by young people.

What justifications do you Americans have for these criminal penalties for such a trivial "offense" as consuming alcohol under 21?
Just a little side note: unless you live in the state of Mississippi, people in the 18-20 age group are NOT "minors". The age of majority is 18 (19 for Alabama and Nebraska). You have to say "person under 21", "underage drinker" or "underager" as these people are NOT minors.
Sure Texas is one of the most lenient states relatively to under-21 drinking, I knew that alreay. However, Texas and Ohio are the only big states to allow parents to give alcohol to their children. In 20 states, including most of the large ones (California, New York, Florida, Michigan, Illinois, Arizona, North Carolina) it’s a criminal offense for a parent to serve any amount of alcohol to their children. Another oddity is in South Dakota, South Carolina and West Virginia, parents may serve alcohol to their children, but it’s still a criminal offense or the under-21 person to drink it.

My point is that any underage drinking related offense that does not involve driving should only be punished by civil penalties, not criminal ones.

I live in the US and completely agree with you. Raising the drinking age from 18 to 21 has had so many adverse effects on young adults drinking. This is because our politicians generally do not do what is good for the country anymore, they just do things that make them look good for the public. There is no justification for giving criminal penalties to a minor who went to a party and had a few drinks. We all have made mistakes as teenagers. However, I give them some credit because they have lightened up a little on the marijuana possession laws. Don’t get me wrong, I love this country, but things have been going crazy lately.

Wrongly accused and stuck with the Public Defender?

I’ve been wrongly accused of a crime, but I do have a criminal record (drug paraphanalia). The police and DA believe that I’m a drug dealer (that’s what the Public Defender told me), so I think that’s why they’re trying me with anything they can.

My problem is that I’ve had the Public Defender several times before and he consistently failed or was totally incompitent. Now I’m facing two years in state prison and I’m scared to death that he will screw this up for me.

Is there any reason other than conflict of interest that would qualify me for a court-appointed attorney in Pennsylvania?
I’m poor and have horrible credit, but if I could I would definitly hire an attorney. If I knew of some way that I could get a large enough loan I’d take it. I’d rather be in debt up to my elbows for the rest of my life then in state prison for two years.

"Belief" is insufficient grounds to persue any charge, it takes "probable cause" in general that means strong evidence.

I don’t doubt your claim of wrongful accusation for a second, i’ve seen it many, many times. If your claim is true, and you know best, then there is onlly one logical conclusion; your being bulldozed by the legal system itself. Unfortunately, this means NO lawyer or any amount of money can stop it. But that doesn’t mean nothing can stop it, you and only you can do that. I’m here to tell you its actually relatively easy, if you merely have basic skills(read & write) i know you can.
