The Life and Death of Public Records
Sometimes it’s the small abuses scurrying below radar that reveal how profoundly the Bush administration has changed America in the name of national security. Buried within the Intelligence Reform and Terrorism Prevention Act of 2004 is a regulation that bars most public access to birth and death certificates for 70 to 100 years. In much of the country, these records have long been invaluable tools for activists, lawyers and reporters to uncover patterns of illness and pollution that officials miss or ignore.

 

In These Times has obtained a draft of the proposed regulations now causing widespread concern among state officials. It reveals plans to create a vast database of vital records to be centralized in Washington and details measures that states must implement — and pay millions for — before next year’s scheduled implementation.

 

The draft lays out how some 60,000 already strapped town and county offices must keep the birth and death records under lock and key and report all document requests to Washington. Individuals who show up in person will still be able to obtain their own birth certificates and, in some cases, the birth and death records of an immediate relative, and “legitimate” research institutions may be able to access files. But reporters and activists won’t be allowed to fish through records, many family members looking for genetic clues will be out of luck, and people wanting to trace adoptions will dead-end. If you are homeless and need your own birth certificate, forget it: no address, no service.

 

Consider the public health implications. A few years back, a doctor in a tiny Vermont town noticed that two patients who lived on the same hill had ALS or Lou Gehrig’s disease. Hearing rumors of more cases of the relatively rare and always fatal disease, the doctor notified the health department. Citing lack of resources, it declined to investigate. The doc then told a reporter, who searched the death certificates filed in the town office only to find that ALS had already killed five of the town’s 1,300 residents. It was statistically possible, but unlikely, that this 10-times-higher-than-normal incidence was simply chance. Since no one knows what causes ALS, clusters like this one, once revealed, help epidemiologists assess risk factors, warn doctors to watch for symptoms,and alert neighbors and activists.

 

Activists in Colorado already know what it is like when states bar access to vital records. For years, they fought the Cotter Corp., claiming that its uranium mining operations were killing residents and workers. Unwilling to rely on the health department, which they claimed had a “cozy” relationship with the polluters, the activists tried to access death records, only to be told that it was illegal in this closed-records state. An editorial in Colorado’s Longmont Daily Times-Call lamented, “If there’s a situation that makes the case for why death certificates should be available to the public, it is th[is] Superfund area.”

 

Some of state officials around the country are questioning whether the new regulations themselves illegally tread on states’ rights. But the feds have been coy. Richard McCoy, public health statistic chief in Vermont, one of the nation’s 14 open-records states, says, “No state is mandated to meet the regs. However, if they don’t, then residents of that state will not be able to access any federal services, including social security and passports. States have no choice.”

 

But while the public loses access to records, the federal government gains a gargantuan national database easily cross-referenced in the name of national security. The feds’ claim that increased security will deter identity theft and terrorism is facile. Wholesale corporate data gathering is the major nexis of identity theft. As for terrorism, all the 9/11 perpetrators had valid identification.

 

Meanwhile, the quiet clampdown on vital records is part of a growing consolidation of information at the federal level. “That information will dovetail with the Real ID Act of 2005,” says Marc Rotenberg of the Electronic Privacy Information Center. “Real ID cards are the other shoe that is scheduled to drop in three years.” That act, signed into law last May, establishes national standards for state-issued driver’s licenses and ID cards, and centralizes the information into a database.

 

Aside from public health and privacy concerns, closing vital records incurs a steep intangible cost: It undermines community in places where that healthy ethos still survives. In small town America, the local clerk’s office is a sociable place where government wears the face of your neighbor. Each year, Vermont’s 246 towns distribute their vital statistics to all residents. “It’s the first place everybody goes in the Town Report,” says state archivist Gregory Sanford. “Who was born, who died, who got married, who had a baby and wasn’t married.”

 

This may not be the most dramatic danger to democracy, but it is one of the Bush administration’s many quiet, incremental assaults on the health of America’s body politic. And it may end up listed on the death certificate for open society.

Fortunately, there are many ways to find details about a person’s past. In fact, it is easy to discover whether or not a person has been married in the past.

how can I find in public records the blood type of my deceased ther? I only have birth and death certificate?

He died 20 years ago and there are no other documents left in our possession.

In the US, unless you catch a flukey, darn lucky break, you aren’t going to be able to acquire that information.

Given this person died 20 years ago, blood typing of newborns just wasn’t done. So there would be no recording on the Birth Certificate (as you probably have already found).

Unless there was some reason to do an extensive autopsy (very rare) it is unlikely any death "record" would have this information either.

So this information would only be in medical records. In the US though, with the passage of HIPAA laws, you won’t be able to get those records unless maybe you are a direct descendant. Maybe.

A little know fact is that HIPAA extends to deceased persons as well as living persons. You can’t release medical information on a deceased individual (one argument, an insurance company could find your deceased parent died of ovarian cancer and thus bump up your rates because you now have a higher chance of getting this condition).

A consequence of HIPAA is that doctors and hospitals are purging old records. Technically, they can’t retain medical records without a medical reason – and clearly there is little medical reason to retain the medical records of a patient that died 20 years earlier.

So unless you catch a fluky, very unusual break somewhere, you aren’t going to be able to get this information (in the US anyway).

Okay Pa laws state a baby must take a breath in order to be considered a living person.

As most of you know we lost our daughter shortly after her birth. At 32 weeks. When she was born she had heart beat therefore being a living person. Pa is one of the only 3 states in the US to have laws that say a child must take a breath to be considered born. So that being said they say that my daughter was considered still born. Every single doctor who has worked with us that night we have spoken to they say she was absolutely not still born. I wondered why I didn’t receive a birth cert for Stefanie so I went to the records office and they told me to fill out a form and they would mail it to me they do not mail them out of respect of the mother. Well the next day I got a call from them and they said she would not get a birth cert because she did not take a breath on her own. And that has got me thinking. Now say she lived but could only breath by machines and say she was on these machines for 3 months. So to the state of Pennsylvania she is not born? So a child could be 3 months old and finally take that breath on their own and then considered born? So what would the birth cert say? They make these stupid laws without even thinking what they are doing. They say they won’t pass the law because of people who have abortions. Well think about how dumb that is if a person has an abortion than they must not have wanted the child so then why the hell would they worry about a birth cert. They have not given thought to the mothers and fathers who would like to have that acknowledgment. My daughter deserves a birth cert just as much as I do and you do and the person who made this silly law. I realize that a birth certificate really doesn’t mean anything but it would have still been nice to at least have something that showed she was here. In my eyes you are a living person when you have a heart beat she was outside of the womb for almost a half hour with a small heart beat. In my eyes, husband, and doctors we feel that is a living person. It is so upsetting I have shed so many tears in these past few months that I wouldn’t be surprised if I was dehydrated.

I’m posting to get your thoughts. Would you be upset and hurt by your child not being acknowledged. A person is alive when they have a heart beat do you agree? Just any answer is fine I guess.

We have a copy of the death cert. Now how can there be a death without a birth?

We have her foot prints, blankets they wrapped her in and her hat, not to make anyone sad but in her hat is a little piece of hair that I just discovered a few days ago. Which is something because the day after I wished I had a lock of her long curly hair and I just happened to turn the hat inside out just to see and there it was. The hospital made us a hospital birth certificate which was very nice of them to do.

She was born May 9th at 11:08pm and the records say time of death was 11:55pm so she lived for almost an hour.

I just wish I could change this law but I’m not powerful enough. Maybe someday it will be changed and she will get what she deserves.

I am so sorry about your loss and the situation with your precious daughter. Im in OK, and the law here is a little different. Our daughter was born at 23 weeks, and lived for 4 hours. I was able to get a birth certificate fine, but couldn’t’ get a death certificate because the on call ped was new and didn’t ever file a death certificate. It was a huge mess – bad enough my daughter was dead, but 10 months later I had to PROVE that she was dead, and had died in the hospital. Finally my ob/gyn went to bat for me adn she wrote up the death certificate for our daughter. I would see if your ob would go to bat for you on this one. I think if she has a heartbeat it would be hard to say that she never took a single breath – but its all medical terminology – they don’t really leave much room for actuality or emotion.

I will be praying fro you and your family, and your precious baby girl. Yes, I would be absolutely upset. What is even more weird is that you have a death certificate and no birth certificate – I would make up my own birth certificate for her if I were you.

Right ,where are they? I had to get a passport several years ago, I had one 20 years before but it expired so I needed a new one. I showed my birth certificate that was from a hospital, it was the only one I had and it was not acceptable. Since 9-11 they needed an official one from the state or city of birth not a hospital. That hospital one was good for over 50 years and now I needed another one. So I had to go to the hall of records in NYC and have a new official birth certificate printed up. So why as just an ordinary citizen did I not have a problem getting a new official birth certificate, and then a passport. Why can’t we see Obama’s official one, what is the big deal, why can’t he just show it. What is he hiding, and how did he get a passport, didn’t he have to show the birth certificate when he got it? I want to see it, I have a right to see it and so do you and all Americans!

I understand the need for answers. However some of these things aren’t going to actually serve any real purpose. Some of it is already obtainable on line.

1.) Although, I understand the confusion, as Obama was supposedly born in Queens hospital before he was born in Kapi’olani Hospital. This is why people want to see a registration of birth (not a live birth certificate).

2) His mother’s death certificate should be public information. She was born 11-29-42 died,7-11-95 age 52, in Honolulu. Her SS# was 535-40-8522

3) The funeral home records wouldn’t be public record.

4) Again Probate records are public information

4) You can find basic information on his 7 step brothers and sisters, on his father’s side, born to four different women. (Their addresses are not, nor should they be public information). There is also another step-sister from his mother and you can find her on line.

5) Father’s name: Barack Hussein Obama. Good luck on a death certificate – he died in a DUI in Kenya 20+ years ago!

6) He refuses to OK the release of these – probably because, according to his friends he was a B- student, not a genius.

7) Immigration records – good luck with that – he didn’t immigrate. He was here on a Student Visa in the 60’s.

8.) He refuses to release this or any college or university records!

Are all those Kenyans lying about our President? Shame on them. His grandmother says she was there at the Coast hospital in Mombosa when he was born. The Ambassador for Kenya, Peter Ogego, admitted that Obamadrama was born in Kenya and he plans to have a monument erected in his honor. Reverend Kweli Shuhubia has signed an affidavit stating that "it is common knowledge throughout the Christian and Muslim communities in Kenya that Barack Hussein Obama, Jr., the United States Presidential candidate, was born in Mombosa Kenya." The affidavit is basically regarding participating in a telephone interview that was done between a U.S. Minister and Sarah Obama, the grandmother. There is a difference between a "certificate of live birth"(what the Obamamaniacs are touting as a birth certificate) and a "registration of birth" (http://www.orlytaitzesq.com/obama-certified-copy-of-registration-of-birth-in-kenya.htm). The first, anyone can get even if they weren’t born there – it’s been done several times in Hawaii, since this issue came up. The second has all of the details of the birth and is submitted very shortly after the birth. Don’t act so superior unless you have some idea about what you are talking about. Obama is a liar and a loser – Deal with that! And if you believe you have a right to privacy, other than in your own home – you are truly uneducated.

To the morons out there, who believe that Osamabama has some particular right to privacy you aren’t too bright. All presidents release this type of personal information. He is the first that hasn’t. Bush and Kerry released their information, as did Clinton and others. Usually there is no need to ask, it is just done.

Therefore, when The One absolutely refuses to release pertinent information, it makes one wonder what is he hiding? If he is so intelligent, such a genius, why won’t he release his college/university transcripts? You think he’d be so proud of all those A’s and would be setting a good example for those little children. Why would he spend millions to fight court action requesting his registration of birth? The entire issue of Obama proving where he was born has nothing to do with Democrats or Republicans – it has to do with the Constitution of the United States, Article II Section I, paragraph 4: "No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States." So, he needs to prove he is eligible. It’s the law!

What do you think about obama’s tax plan and being called selfish and unpatriotic if you are not willing to pay more taxes? What about the people who are not paying taxes and will receive a check (that comes out of taxpayers pockets?) What about the biased press and media – ACORN – his aunt here illegally (who will vote?) No birth certificate, health records, release of college thesis? What about his prediction that the coal industry will go bankrupt under him? What about Rev. Wright and other reputable friends/advisers? What about Joe the Plumber getting death threats for asking a simple question? About the McCain supporters getting kicked off Air Obama- the Florida anchorwoman? My son’s friend’s car which was keyed for having a McCain sticker? My other son’s friend who was punched for supporting McCain? Please answer these questions honestly and not in anger and I may vote for obama tomorrow.

Due to the uncertainty of Obama, I voted for McCain. I was a Hillary voter. I voted Republican across the board. Your question solidified my vote for McCain.

There isn’t a central site. Birth records are usually kept hidden for privacy’s sake.

If you can see kangaroos nibbling your roses, or say "Eh" at the end of every third sentence, you are out of luck.

Your birth certificate will tell you your father’s birth state and age at the time. His SSN application will tell you his parents’ names and his exact birth date. You can get it, but
1) It costs $27
2) He has to be dead
3) He had to have had a SSN.

If your mother and he were married and you live near the town they were living in when they married, go to the library and look through the social pages for that week. You may get lucky; if they had an article there, it will be chock full of good stuff; "The groom is the son of . . .", "Best man was his brother . . .", the bride is the daughter of . . ." and so forth. It will be free, too. If they were living in Fresno but ran away to Las Vegas to get married, there still may be a snippet in the Fresno Bee.

The county clerk may let you look at the marriage record for free, if you go into the office and prove you are related. That isn’t on-line, but I thought I’d mention it.

A lawsuit that tried to force the State of Hawaii to release a copy of President-Elect Barack Obama’s birth certificate has been dismissed.

Honolulu Circuit Court Judge Bert Ayabe on Wednesday ruled that author Andy Martin had no standing under state law to obtain a copy of the birth certificate.

Ayabe said in his decision that Martin had no “direct and tangible interest in the vital statistic records being sought.” Hawaii public records laws are more restrictive than in many states and allow birth and death certificates to be released only to family members and those with a “direct” interest.

The inability of Obama critics to put their hands on his actual birth record from a Honolulu hospital in August 1961 has fueled rumors that he wasn’t actually born in the United States but instead was born in Kenya, his father’s home country.

Martin, a Chicago-based author and Obama critic, moved to Hawaii in November in an attempt to dig out more information about the candidate and filed the lawsuit demanding access to the birth certificate.

In response to the clamor, the director of Hawaii’s Department of Health, Chiyome Fukino, confirmed that Obama’s original birth certificate was on file and that she had personally seen it.

The above is a news report I found online, there are many others that say the same thing. Why are people so desperate to claim Obama isn’t a citizen? Oh wait, because they lost the election and are now crying about it. I bet these same people were calling Al Gore names when he was demanding a recount, which was actually a LIGITIMATE CONCERN.
All the info I am finding says he was born in Hawaii. This cam from FactCheck.org:

And besides, all cadidates get vetted before they can even run for president, something as important as U.S. Citizenship would not have been overlooked. The companies that handle the vetting proccess aren’t biased one way or the other, they just look at the facts. Once the the candidate is vetted, he or she can run, all the fact checking for eligablity is done beforehand.

He had her taken out of the hospital October 19, and now the funeral home employees and coroner’s office employees are saying she really died October 21. Remember Barack "suddenly" went out there October 23rd? Maybe so he and his cronies could go through her things? Remember we all thought she’d died Nov.3, then Nov. 2, and that all this time she was "on ice" awaiting a funeral, which she had only Barack never attended? And then yesterday he tossed her ashes over a cliff in Hawaii finally?
According to sources employed in the coroner’s office Madelyn Dunham died on October 21, 2008 and was cremated on Friday October 24, 2008. It is further claimed that the death records of Madelyn L Dunham were falsified at the direct and specific request of Barack Obama and Maya Ng. This has been filed with the Hawaii Attorney General’s office.
Remember at the end of October Michelle said that Madelyn Dunham was "doing fine", and remember Michelle nor the kids came to visit "ailing granny"? Remember that though her 89th birthday was October 25th nobody, not even Barack or Maya visited her?

I know 0bama supporters worship his &()*^%%, and they will say a bunch of abusive nearly criminal insults, but to normal people this guy stinks. That again is to NORMAL people.
