Possible legal trouble with the ex… VERY LONG… sorry!?

May 31st, 2011 3 comments

So… another legal(s) question. I NEED to get a lawyer but of course no ones around until Monday and I will worry myself to death until then. My ex calls me tonight. This is all about the issue a few months ago where my son asked to be adopted… So my ex tells me tonight that I will be getting served with papers hahahah…

When I ask what for he tells me that there are several things pending with the state att. 1) fraud. his child support is auto deduct from his check. In the past his company has over paid me and when I took steps to give it back I was told that all I had to do was agree to allow them to take "X" amount out of each payment in the future to cover it and that’s the best way to resolve this… that is what I have been doing. The last few weeks they have been double paying me. I called them and as per the agreement they told me that if his company sends it in with my name that they have to give it to me and if it is a over payment then they will just keep taking "X" amount until it is covered. Fine not a problem… he states that my case worker (at my request) has forged papers saying that he is in arrears and that they have auth the state to take double payments until this is caught up… I have not been to court / talked to judge / filed ANY sort of papers about child support. I am clue less but needless to say PER HIM I have a fraud charge coming.

2)He then tells me that he has hired a PI and this person has been following me for the last 8 weeks… they know every breathe that I take (If this is true then I hope this person was bored to tears!) States that he now knows everything about me… my employment record, 9 years of bank statements. Both of my kids school records (my daughter is not even his…) ect…Because of this, this has helped the state prove that there is cause to file neglect charges on me and take my kids… now maybe i am stupid but wouldn’t DCF or some other agency have to look into this. Visit me, visit my home ect? I have NEVER been visited my DCF or had cause to have them visit me.

3) my husband in under a PTI. This is for theft and his first offense ever. He was adv that as long as he behaves / shows up for his monthly check ins / pays the fines / does not get in any trouble that there are no other restrictions… he can come and go… drink even within reason and leave the county as needed… we went to NC back in Feb… My ex caused me and my husband to fight. It was bad and my ex called the cops. He is telling me that with one phone call he can have him arrested for this issue… the cops that responded at the time of issue ran his name… checked all his info and released him from the scene. How the hell can he cause my husband to be arrested for a issue that happened out of state when the responding cops did not see fit to?

and last I promise)
4) he says that the states has me for insurance fraud… Both of my kids are on Florida Kid care. have been for years. My ex now states that he can prove that he has had insurance on my son for the last 9 years and I just failed to use it… This is not something that I was ever advised of. In fact he told my mother that when we divorced the judge told him he had to pay for it…not give me the info… It’s hear say but….

1) Hmm.. Try looking at that from his perspective. How would you like it if a big chunk of your check was being taken out and you knew it wasn’t supposed to be? And then the response was "we’ll just take out less later. Good luck with your bills for THIS month!" I’d be pissed too. And so would you – don’t deny it. It sounds like a big misunderstanding, but you should really try to get this fixed as soon as possible. He may have a case here.

2) Creepy, and probably BS if you haven’t heard from any officials. And not to his benefit if it’s true and hes just waiting to report you. If he knows that his child is being neglected, and he’s letting it continue for personal reasons, then he’s neglecting the child too.

3) Yeah…kinda bad for you’re case there. When you say "fight" do you mean like fist fight, or screaming fight? Because that’s kind of important. He probably can’t get your husband arrested for that, but it’s something you need to maintain an awareness of. Also, if he was out of state, and his case worker doesn’t know about the incident, and if it was a violation of 1 of his conditions, then your ex may have a point… Tread softly.

4) Fraud in an intentional crime. You can’t defraud someone if you don’t know an alternative exists.

5) What’s the story about your kid asking to be adopted? Adopted by who? Is he asking to live with his father, or just with some random couple? That kind of makes me wonder about that whole neglect thing and if that isn’t just a story. How old is the kid, and why does he want to be adopted? That could be a major playing card for your ex.

I don’t mean to make you panic, but if your ex has a decent lawyer, you need one too.

This is long… possible legal issues with the ex?

I will use initials because the word is not acceptable on yahoo, but what he is feeding you is BS and none of it is even close to the truth. He cannot do any of the things he is claiming and he is trying to intimidate you, there is an old saying and it has connotations that are best not explained, Tell him to pound salt and stop worrying that is his intent and you are falling for it speak with an attorney and if in fact a PI had accessed the financial information that he claims it would be illegal and the PI would lose his license. Tell him his BS smells and you will see him in court.}{

Ok first of all.. calm down… him saying things, and these things being true could be two different things.. so until u actually get served dont read to much into it.. he could be blowing smoke just to freak you out.. and if thats the case well , its working..

The child support will straighten itself out.. not a big deal a judge will figure it out and they will just let him pay less for however long until its caught up .. 50 a month or whatever until its fair again.. (although if he’s making more money now then he was when c/s was issued could back fire on him if your lawyer (if he actually is having u served) counters with a modification that could make his c/s increase which would wash it out if not make him owe u even more.)

LMAO@ the case worker upon your request forged documents lol wow you have alot of power.. bet u didnt know that lol.. so much so that u could get a state worker, to risk their job to forge doc for you lol.. he’s full of crap , he’s grasping at straws.

PI.. wow your x must be really rich if he can afford a PI for 8 weeks.. and he’s complaining about a few weeks of extra child support yet he can afford a PI for 8 weeks.. tell him to show u proof.. lol and im pretty sure that if they tapped into your bank records for the last 9 years , thats not public knowledge and im pretty sure he or the pi could get in trouble for that so again i think he’s full of crap..

If he’s not on your daughters list of people of contact ( listed as father etc) then you can sue the school for giving out any information on your child that isnt his.. he has a right to the records on his son unless u have court papers stating otherwise but your daughter is another story .. and typically the schools check before giving out any information on a child.. they will check your license to make sure your on the contact list.. As far as the neglect.. you know if you neglect your children or not.. do u feed them, bathe them, put a roof over their head, are u making sure they are provided for and go to school.. if so he has nothing.. and DFS would laugh in his face.. btw you said he’s out of state.. what did he do drive from his state just to go to the kids schools to get a copy of their records??? lol..

LOL your x is an ego maniac he cant call the cops on a situation that happened awhile back that was already handled.. he’s full of himself he’s trying to intimidate you and scare you.. tell him to bring it! because he’s full of crap , id even be willing to bet that if not 100% atleast 95% of what you’ve put here that he’s said is b.s. and he’s just pissed and lying out his butt to try and scare u.

Tell him to prove it when it comes to the insurance fraud.. can he prove he sent u a scaned copy via email, or a sign reciept through snail mail that he gave it to u, etc because if he cant prove that he gave it to u, then it cant be proven that you had it.. now if at the last judgement it is recorded that they gave him a deduction in c/s because he had medical benefits on the children and you continued to use Kid care then possibly you could get in trouble.. but if at the time there was no proof of insurance for the kids then i wouldnt worry about it.. and tell him your still waiting on a card because he has to give u one in order to use it.. he cant "NOT GIVE U THE INFO" lol let him tell that to a judge lol.. better yet.. email him about the insurance see if he’s stupid enough to put that in an email and show that to a judge lol…

Dont let this guy get to u.. id be willing to bet that he’s full of crap.. Dont worry until theres something to worry about and if you dont have papers in hand.. then theres nothing to worry about.. no need to get a lawyer until your served because i think he’s blowing smoke.. and even if he’s not, your lawyer cant do anything until you get served anyways to actually read what he’s suing you for.. so stop getting stressed out over this stupidity.. He has nothing.. based on what you put here.. and most of the things u said, sound far fetched…. so dont let him rattle you.. just say "COOL cant wait to see the papers" and get off the phone.. stop letting him bait u into a conversation..

Where do I find a record store or a music store in New York City?

March 18th, 2011 2 comments

I want to buy some albums (Death Metal) and I have no clue where to buy such.

J&R Music World is the best shop that I know. They seem to have everything. Easy to find, they are at the foot of the Brooklyn Bridge, across the street from City Hall, near the Woolworth Building, quarter mile from Wall Street, two blocks from the WTC site and so on.

How do I look at online records without having to pay at all for them?

March 15th, 2011 1 comment

I’m doing family history research, and I’ve been trying to look up birth, death, marriage, etc records. Every site I go to you have to pay SOMETHING for them. I want FREE online records that I can look at ONLINE without having to pay or get them shipped to my house.

My Mom said to look at court houses, but I can’t find our court houses online.
I live in Mississippi, but I’m looking for records in Pemiscot County of Missouri. That’s where most of my family moved to in the 1900’s on my Dad’s side. On my Mom’s side, I have no clue. Probably Tennessee because they were full Cherokee Indians. And she is half Cherokee Indian.

My Great Aunt has done my Dad’s side of the familys history all the way back to before the civial war, but she’s too picky to share with me any of it.

Anyway, if anyone knows a completely free website where you can look at ONLINE records, then please tell me. And remember NO PAYMENTS. NONE. lol. Most people that answer me always give me a website and they still have some kind of a payment on there. And I don’t want to have to pay anything at all.

There is a site called Heritage Quest that is completely free, but you must get the access code from your public library. Call the library and ask if they subscribe to Heritage Quest and how to access it. You do this online from home, but most libraries require you to have a library card to get the access code.

Possible clue found on great-grandfather: How can I gather more information on this possible person?

April 11th, 2010 3 comments

http://pilot.familysearch.org/recordsearch/start.html#searchId=112849134813955540000;surname=Madigan;birthPlaceId=1;birthPlace=United%20States;givenName=John;searchType=standard;birthYear=1880;p=recordResults

Do you think this could be my great-grandfather? My grandfather Thomas Madigan was born on February 24, 1919 in Brooklyn, NY. He was the tenth of ten children, so it’s possible his father could have been 39 years old when having him. His wife (my grandmother) was also born in 1919 in Brooklyn, NY. She was the seventh of seven children, as her father was was born in 1880. On this link, it says John Madigan (the name of my great-grandfather), was born in May 1880, so it’s in the same time frame. The key though is that it says in the 1900 U.S. Census that he was residing in Brooklyn (Kings). This would have been two years after Brooklyn was consolidated into New York City.

I know for certain that my grandfather’s parents were born in the United States, although I’m unsure of where. It’s possible it could be in New York, but it’s possible it may not be. I’m unsure of where his grandparents were born, but I know he was of Irish descent. His grandparents may have been Irish immigrants. In this link, it says John Madigan’s parents were born in Ireland. On this link, it says that John Madigan was born in Boston, but I don’t know if that means in Massachusetts. My grandmother told me that John Madigan died at 69 years old, which she remembered, because my grandfather (Thomas Madigan) ironically also died at 69. I’ll ask my grandmother if she knows when he was born (if it was May 1880). Or if she knows what year he died (I can track 69 years before that). When it says Boston, I don’t know if that means in Massachusetts, because it doesn’t say so. There is a Boston in the state of New York.

On this site, and on Ancestry.com, this is the only John Madigan I’ve been able to find that resided in Brooklyn, Kings, New York, in the 1900 Census. This is also the only John Madigan I’ve found that has resided in Brooklyn, that was born around 1880. There were some in Manhattan that could have matched too, but this was the only one I found in Brooklyn. If there’s any help anyone could provide, I appreciate it. What I’m looking for is more information on this exact John Madigan. Like who his parents or siblings may have been. I’m also seeing if there’s a death record that may be on a John Madigan in 1949-1950 in Brooklyn, New York. I know there was a Census picture document to go along with it, but I was having trouble making out the writing on it. Maybe you’ll have better luck. Also, I’ve found a marriage record on a site to a Margaret Finley (or Findley) on July 24, 1898 in Manhattan, New York. Margaret Finley was his wife. It’s possible he could have gotten married at 18 years old, although I don’t know there.
It’s the third one on the page.
On the Family Search site, if it doesn’t work when you click on it, if you search John Madigan ”Birth/Christening” United States, you’ll see John Madigan come up third.

I’ll look in that New York Times article you posted. That sounds like it could be in the right neighborhood. If he died on Feb. 22, 1951, and he was born in May 1880, it wouldn’t have meant he would have died at 70 years old, which is only a year above the age my grandmother said he died at. If he died in May 3 1951, it’s possible he could have been 71 years old when he died, if this matches, but in the 1880 link it only says he was born in May. He probably would have been born after the 3rd in May, since there’s obviously 28 other days in May.
Hi Wendy. It’s coming along alright. Still gathering little bits of information. I’m not sure if they were married in 1898, but you’re right that if they were, it would contradict it. It’d possible there could have been another marriage of John Madigan and Margaret Finley, in a largely populated city, because they’re somewhat of common names. That marriage wasn’t in Brooklyn, NY though. It was in Manhattan, which leaves me skeptical. I’m unsure of what the exact date of the consolodation of Brooklyn into New York City was in 1898, but I’d imagine if it wasn’t apart of their city at the same, they may have not wanted to get married there. Plus, as I’ve mentioned, my grandfather grew up somewhat poor. Manhattan, for things like marriages, has historically tended to be expensive, so I don’t know if they would have been able to afford getting married there.
How exactly do I get down to that article on the New York Times page? I know I should go to the 1851-1980 tab? But I looked on page 28-29 and didn’t find it.
http://query.nytimes.com/search/query?frow=0&n=10&srcht=s&daterange=period&query=John+Madigan&srchst=p&hdlquery=&bylquery=&mon1=02&day1=22&year1=1951&mon2=05&day2=03&year2=1951&submit.x=31&submit.y=12

I found it in the search engine in those dates you showed me. I’d imagine it’s possible it could be a duplicate article on the same person because both have the middle initial J. This could be the person I’m looking for though. It says it cost $3.95 to order it, which the price obviously isn’t a big deal, but I don’t have a credit card. But I’ll ask my brother.

I believe it was this answer you were referring too. This has John Madigan being born in May 1881, meaning that if he died in either February or May 1951, he would have been 69 years old when dying, as my grandmother indicated.
I’m not sure if that was the answer, as it was for the 1900 Census, but it could be correct. The only thing that could be off is that it says he lived in Queens, New York in 1900, but it’s possible that he may have moved to Brooklyn, when moving out, prior to my grandfather’s birth in 1919. My grandfather was from the Williamsburg neighborhood of Brooklyn, which actually isn’t that far from Queens or Manhattan. It had him listed as living at home in 1900, when he would have been either 18 or 19 years old.
Woop that was the wrong side lol I believe that is true on the Clark side though.
Yes, the information provided on that link is correct, as all the names of the children match up identically. It’s gradually added to appropriately in the 1920 and 1930 Censuses. The only confusion I had there was that it said this:

”John Madigan 34 Married 14 years Parents Ire English”

I looked up where ”Brooklyn Ward 14” was though, and it said East Williamsburg, which is likely where my great-grandfather lived in 1910, since my grandfather was born there in 1919.

Yet it said above:

”Father’s Birth Place: Ireland
Mother’s Birth Place: Ireland”
If he were born in 1876, it’d mean he probably would have died 1945-46.
Yeah, this could be it. The 4th one shown shows Margaret Madigan dying on April 23, 1922, at 44 years old.
http://www.italiangen.org/NYCDeathresults.asp?kind=exact&Esurname=Madigan&Efirst=Margaret&StartYear=&EndYear=1922&County=Kings&B1=Submit

was wondering how you were coming along, Tom…
I pulled up the John Madigan in 1900, born May 1880. This John is single, and living with his widowed father. No wife. If John and Margaret were married in 1898, this contradicts it.
An 1898 marriage to Margaret is just about right. Meaning, they were married 21 yrs in 1919.. and like many persons in that day.. the standard is a child every other year.
By the way.. I love that site. Experience helps to read the stuff. Look at the top, and you can save it as a jpeg to your computer. Also.. look to the side of the "save file" thingie, and there is a slider bar which allows you to zoom on the image. The drawback is not having 1910, 1920, 1930 so you can check all three.
You also are hitting a certain time frame that is real tricky. I call it the 1890 "hump", where the 1890 is gone to a fire. Children born in 1880 or so, are often married by 1900, which means that 20 yr gap will leave them out of any census with the parents. The exception, if they do NOT marry by 1900, or..sometimes you luck out, and the parent now lives with the children.
edit
Tom.. go back to the 1910 census summary that tukmyhamster sent you, a few days ago.
It gives John’s age 34 (born about 1876); married 14 yrs (about 1896) and check closely on the ages of the kids.
1880 is not the right guy.

http://answers.yahoo.com/question/index?qid=20090228005522AAzRM2R
there is a discrepancy on John’s age between the two census.. so there is a range to be looking at.
ONE of these (full copy) would include the month/year of birth,
one claims father born Ireland, mother born England..

tom, your email is not open to send things after you may have stopped reading.

run Margaret Madigan through this with Kings as location, and I think I find her death date in 1922.

A woman caught me peeing in my backyard and called the cops, what can I expect?

January 2nd, 2010 13 comments

Its a messed up situation,so please help, Im scared as hell. Instead of going up to the bathroom I lazily started peeing in the backyard. It faces an alley. A woman driving by saw me and told the cops I was publicly exposing myself to her, and I was 100% not doing that. Now Im lazy stupid and wrong for going outside, but I cant prove that, nor can she prove I was exposing myself. I was released and told Ill get papers in the mail, then have to go to the court house and take care of stuff. I was never told anything besides that. Does anybody have any idea what Im likely to be charged with? I know its possible for public lewdness, exposer, or public urination. When I say one thing and she says another, how is that figured out? Can anyone help me, please??? I really truly need it. Im 21 with no prior record, I live in Pennsylvania. I am scared to death what this might do for my future, please help me out.
Thank you all very much for the advice firstly. Secondly a couple more fuzzy details. It says that I could possibly have to be a registered sex offender because of public exposure, just for urinating in public charge. And can anyone else tell me what to expect? As far as, they let me go and told me Id recieve something in the mail. What then? Im not familiar with any of this stuff so I have no clue what Im doing here. Thank you all for your responses. I thank each one of ya more than Ive ever thanked anyone.

That happened to me. I ducked into an alley to take a leak, and a woman saw me. She said I was exposing myself to her, but I said I was taking a piss. The judge agreed with me, and charged me with public urination, which is the equivalent of a traffic ticket.

Question Death Certificates from Vital Records in New York City?

December 11th, 2009 6 comments

I want to order the death ceriticates of 7 of my 8 great-grandparents. I already know where one was born, so I don’t need that one. I pretty much know where all of them died. That’s not what I’m looking for. What I’m looking for is if that record says where they were born too, and if possible, who there parents were. It costs $15. I’ll probably order one and see what it says, and than do the rest, but it takes like 6-8 weeks in between. Based on personal experience though, has it said place of birth on it?

I agree with Wendy.
Order the death certificates.

Knowing whether or not your ancestors died from a disease/health condition that may affect your health is worth the price of the certificate.

I have the death certificates of my paternal grandparents, maternal grandmother, my dad, 2 older brothers and a sister, as well as my 2nd step-mother-from Hell, all from Florida.
All show their birth dates and places, dates, times and places of death, their occupation, place of residence, the name and address of the funeral home, date of burial, names and places of the cemetery(s) and parents names.

If a death certificate gives you just one new piece of information, it’s worth more than $15.00.

Even the smallest clue can become the biggest clue.
